The Pendle ton East Oregonlan said last night: R. W. Deal, one of the oldest plo- neers of Union county, and tor 40 years a prominent horseman of the In land empire, is on trial in the circuit court In this city today for the theft of a horse, the case having come here on a change of venue . from Union county. About 20 witnesses, many of them among the most prominent pioneers of Grande Ronde valley, are attending the trial and it is of more than usual Importance owing to the prominence of the accused. Deal Is a white-haired man of perhaps 10 years of age, la on trial for the second offense In the past few years In Union county. In this case he Is accused of hav ing stolen a horse from E. L. Hailey, a young farmer residing near Island City. It Is alleged that Deal took the horse from the range near La Grande, shipped It with others to Portland and drove It from there to Salem, where he sold It. District Attorney F. S. Ivanhoe, of the Union-Wallowa county district, is prosecuting the case, while J. D. Sla ter of La Grande, a brother of Attor ney R. J. Slater of this city, ts defend ing Mr. Deal. The case was called by Judge Bean at 9 o'clock this morning and the forenoon was spent In secur ing a Jury. Among those who are here from Union county as witnesses are the fol lowing well known citizens: D. A. and J. W. McAllister, George Childera, Sheriff Frank Childera, D. D. Gran dy, Dexter Eaton, Charles Teal, Fred D. Gaskell, E. L. Hailey and several others. This ts the stcond offense of this kind for Mr. Deal in the past few years. The horsr Wotan Is, of course, under control of his mistress, Lena Marrder, but only a perrormer or intrepid spirit and adamantine constancy could endure the ordeal of that balloon ascent an descent, the latter made amid the be wllderment of fireworks!
