M. j the O. R. & N. company, charging htm with Tiolatlon of the 14-hour law and the railroad official will have to plead to the same before Circuit Judge H. J. Bean, says the Pendleton East Oregontan. i In several ways the indictment filed against Mr. Buckley Is one of Interest. It is the first criminal action ever trousht unicr t.w that was passed at the last session of the legislature. Incidentally it will prob ably be the last one for the recently enacted federal law, making II hours the maximum time railroad men may be kept at work, supersedes the state' law. , However, the federal law did not go into effect until March' 4, and as the offense with which the railroad com pany Is now accused occurred In Oc tober, the general superintendent Is subject to prosecution under the state law. Henceforth vlolatjons will be prosecuted by the federal courts. In the information filed today, M. J. Buckley and John Doe, the latter being the train dispatcher at The Dalles, who was then on duty, are both charged with violating the' law on October IS, 1907. The railroad HOBSON TO PENDLETON. Hero of tho Merrlmac May Speak In Pendleton Soon. If It is possible to secure him for a lecture in this city. Congressman Richmond P. Hobson will be borught here at a later date this spring, says a Pendleton paper. If 'he cannot be secured, a substitute will be brought here to fill his appointment or else the money collected for the Hobson lecture will be refunded by the high school. This announcement was made today by Superintendent J. S. Landers and Principal Hampton of the high school. Mr. Landers has already writ ten the Merrlmac hero, laying the facts of the case before htm and ask Ing him if he can come here at a later date, the time being left to the speaker. According to the high school peo pie they regret deeply that Hobson was not here at the time set' for him, but the fault was with the lecture bureau manager and not with the lo cal people. The latter acted entirely In good faith In selling tickets for the entire course, of which the Hob- son lecture was one of the five. Since the first of the week Supt. Trial battle free. record for that day shows that freight train No. 22 bound from The Dalles to Umatilla, was upon the run for a period of 17 hours and five minutes. The case was referred to Mr. Phelps by the railroad commission, who ask ed that. It be prosecuted. Acocrdlngly an Investigation was made by the dis- trict attorney, in the course of which he took testimony from J. P. O'Brien, general manager, Mr. Buckley and others. No reasonable excuse for the delay was offered by the railroad ceo- ole and It Is believed that a plea of guilty will be made when the case comes up in court. At the same time the above case was given to Mr. Phelps two other charges were also filed with him. However, the offenses occurred in the other judicial district so no ' action has been taken by Mr. Phelps. Under the state law the penalty for violating the 14-hour law varies from a fine of from J100 to $500, Imprison ment In the county Jail from six months to one year, or both. , It is very probable that the facts In the present case will be stipulated and passed up to Judge Bean without a trial. Since October the dispatcher then on duty at The Dalles has re signed and his present whereabouts are not known. , NEW FILMS COME. Electric Theater Now' Running With Usual Attractions.
