with democrats. Governor Johnson
has adhered steadfastly to his utter
ances of the last six months that he
! was not a candidate for the democrat
ic nomination for president. He sup
ported Bryan In the two campaigns
of 1896 and 1900 and Judge Parker In
1904.

Blgelow and the late Leonard Lewl
sohn of Now York, were the persons
who acted as promoters to arrange
for the purchase of a large amount
of property for the Old Dominion
company for prices grossly in excess

they should be held accountahl,.
the profits wrongfully received.
The Massachusetts courts deeldnd

circuit court for New Tork held that
the company could not recover against
the estate of Lewlsohn, and an appeal

United States supreme court, the test
case of the Galveston. Harrishtirg &
San Antonio Railway company, a Har
rlman line, against the state of Texas,
will probably be submitted this week.
This Is the case in which the rail
roads of the state are seeking to test
the constitutionality of the act of the
29th leglBluture. known as the Love
bill, levying an occupation tax on ti,
railroads, measured by their gross re
ceipts, and upon Its decision hangs the
question of whether or not the state
of Texas will collect amounts aggre
gating nearly a quarter of a million
dollars.
