The city of La Grande doe ordain as follows : , ' Section I No person, firm or corpor ation shall be engaged in, carry on or conduct the sale of any merchandise, at public auction, or by public out-cry, either a an auctioneer, or a the owner or occupant of the place or premise where such merchandise is so offered for sale, at any p!ace within the city of La Grande, Oregon, without first having ob tained a license therefor, as provided in this ordinance. Section 2 Every person, firm or cor poration desiring to sell merchandise within La Grande, Oregon,' by auction, whether such merchandise shall be the property of the seller, or the property of another, and every person, firm or cor poration desiring to engage in the pro fession or occupation of an auctioneer, either to sell their own . merchandise or that of others, within said city, shall first pay to the City Treasurer a said city the sum required by the ordinance -to be paid for a license to engage in said pro fession of auctioneer, or to sell such mer chandise by auction or Dublio out-ervr that thereupon such person, firm or cor poration, with the receipt of the City Treasurer aforesaid, shall apply to the City Recorder of said city for a license according to the terms of such receipt whereupon, if such City Recorder shall find that the applicant or applicants, a the case may be, h? fui y complied wi h the provisions of this ordinance, he shall issue to sush applicant or applicants, such license as such receipt shows them to be entitled to. Section 5 That every license issued under this ordinance shall sat forth r the name of the applicant or applicant,, and the place where " merchandise shall be old under such license, if the same, be given for such purpose; the time .said license shall be in force. And any perspn carrying on the profession of an auction eer, or, as such offering for sale any merchandise, at public out-cry, or per mitting the same to be done at or in. his place of business, whether by himself ,or another, or whether he is the owner of the merchandise offi.-ed for sal or not! hall on demand of any city officer, , produce such license, and if he fail, refuse or neglect so to do, he may be taken and deemed and convicted for so telling or offering for sale,' such marchandise, or for carrying on the profe Ssion of an auct ioneer. Section 4 That in any action brought under, or arising out of the provision of thi ordinance, that a party to . such action represented himself, herself, or the corporation for which he or they acted, as such auctioneer, or that he, or they, as the oase may be, advertised or exhibited any sign calling the' attention of others to ihe fact such party would or did offer for sale at aution, any merchant dise, shall be sufficient and conclusive evidence that such party Is liable for, the payment of such license, or for the viola tion of this ordinance. Grant. , KOP LAXATIVE - r. ill u faring merchandise for tale, liable for the payment of a license under this ordinance Section 6 Auctioneers shall be of two classes, namely, first and second clats The first class shall be those who carry on their business at a designated place, wnicn snau dc Known ana advertised as an auction house, only, which place shall be specified in the license of $1 000 per annum.and no license shall be granted to an auctioneer, or ' for the right to sell merhandise at uch a place, for a less time than three months, which license shall be paid in advance in gold coin. The second class shall consist of those who sell and conduct temporary sa'es. covering less time than three months, at auction or public out-cry, any stock or part of stock of bankrupt ' goods, goods damaged for general trade, or general merchandise, or for sales in such manner of gold, silver or plated ware, precious or imitation precious stones, watches, jewel ry or other or similiar articles, either at retail or in bulk; and auctioneers, or those desiring to sell such merchandise in tuoh manner, either as to time or place, shall pay a license of $25 per day, for each and every day of the continuance of such sale or sales, and no license shall be issued in this class for a less term than i 0 days, which license shall be paid in ad vance In gold coin" . Section 7 No aiir.t.ionr r selling goods or merchandise at public out-cry, shall ring, or permit to be rung, ior about, in front of the place of sale, of In or upon publ c street of the ci y cf La Grande, before, after or during such sale; nor permit, before, during or after such sale, any singing, music, loud noises, or the parading of signs upon vehicles or by persons or otherwise, in, upon or about the place of eale. or in or upon the streets of La Grande, Oregon, unless such auct ioneer or person, firm or corporation de siring to sell merchandise at auction or public out-ery shall first obtain a permit from the recorder of the city of La Grande. Oregon, for which permit a fee of $2.60 shall be paid to the treasurer of said cjty for" each person so ringing a bell singing or playing music for each day 'so employed. Section 8 No auctioneer, or person owning orae agent for the owner, shall offer for safe in said city of La Grande, Oregon, any article of merchandise of any' character whatever, or . any , article of either gold, silver, or plated ware, watch es', jewelry tt "precious " stones, without stating at the time and when making each sale, in a loud and distinct voice, that the article ie sold without any warrant or representation whatever, as to it quality; or, that said article 1 expressly warrant ed to be in quality and quantity as repre sented by the auctioneer. ; Section 9 An auctioneer so selling and warranting any merchandise whatever, either for himself or for commission, or as the agent for others, shall retain in bis possession the money, or other ' valuable thing or things received for such' mer chandise of any description herein men tioned and described, for at least twenty four hours from the time of such sale. And if any purchaser of any article, thing or merchandise of any ' description "as herein mentioned, shall,; within twenty four hours make a claim against such auctioneer or person owning or ' claiming to own such article at the time of sale to such claimant, upon the ground that the article thing or merchandise so sold at auction, was not as represented by the auctioneer, and shall demand of the auc tioneer a return of the money or other consideration paid or given therefor, and shall offer to return the article, thing 'or merchandise so purchased ' or received, then and in ' such case, ' the auctioneer making such sale shall either ' return said purchaser the purchase price paid there for, or hold said purchase price received for such article, thing or ' merchandise at such sale, as a separate and distinct fund to answer and pay any judgment that may recovered against him by the pur chaser of such article, thing or merchan dise; provided, that if no action or pro ceeding be brought against said auction eer or person offering for sale such article, thing or merchandise, for a period of ten days from and after the date of such sale, such auctioneer shall not be required , to keep the purchase price therefor in a sep arate fund thereafter. , Section 1 0 If any person, persons, firm or corporation shall' violate any -of the provisions'' of this' ordinance, upon proof 'of Such violation, before the city re corder, he, she, they or it shall be fined in a sum not less that $80 or more than $100, or confined in the city jail of the c ty of La Grande, Oregon, for a period of riot less tnan ten days nor more than ninety daysor by both such fine and im prisonment And in adaition to such fir.e or imprisonment or both, tne city record er shall revoke and annul any licence that may have been issued to such person, persons, firm or corporation, and a'.l money paid therefor shall thereby be for feited as a part of the penalty for the vio lation of this ordinanoe. 1 Section 11 This ordinance shall be published in one issue of the La Grande Evening Observer and will be in full force and effect from and after the 10th day of March, (908.
