-B TWO RAILROADS ON
ONE RIGHT-OF-WAY
Elgin is tbe center of attraction jnst
at present, so far as railroad building
is oonoeroeJ. There is more railroad
talk in and about this thriving burg
than at any other point in the west.
The reason for all of whioh is, that
twd railroad companies are seeking to
build a railroad over the same right of
way, and' into the .same region. A
month or six weeks ago a Mi Oook
stepped off the train at Elgin, and be
fore be had been in town many days,

it became noised about that Mr Oook
bad secured a right of way through
many of the farms along the proposed
route. Finally this information be
came known to the officials of the 0 R
A N Company, and tboy were impiess
ed with the tsot tbat something was
, doing in this section of the state where
' they were supposed to hive first rights.
They instituted a quiet investigation
This little attention on the part of the
pioneer company only served to cause
Mr Gook to increase his energy and be
proceeded to gather in right of way
' contracts with greater rapidity. Ths
' O R & N, seeing thai affairs were tak
ing somewhat serious turn, develop
ed soma speed and dispatched their
k'ngents, armed with a eueok book, to
this here-to-fore peaceful neighbor
hood, to puronase rights of way. The
OBAN Company not only paid eash
for the right of way, taking a dee i for
'tbeeatne, but furnished a good and
'sufficient bond, binding tbe company
to protect tbe property owners against
any loss whioh might be assessed
against them by their failure to live
up to the agreement made with Mr
Cook's company. Mr Cook, seeing
tbat he might be placed at a disadvan
tage by this f lan of bis older rival,
changed his tactics to conlorm witb
tbe new order of things, and made
and delivered a similar bond, binding
his oompany to protect the land own
ers againet any action which the O R
&N Company might take against

tinue, he will demonstrate what real
road building amounts to, and tbo

they take bis efforts seriously, and in
turn claim tbat they are tbe real road
builders and tbat tbey, and tbey alone

While this may be true, Mr Oook is
tbe first to break tbe : virgin sod, as
last Saturday ha rmed four men nd
two boys witb picks and rhcvels, and
placing them in charge of an experi
enced foreman, began grading.
Mr Cook" states that be baa let tbe
contract for the construction; of tea
miles road, and tbe contractors are ex
peoted to begin work as soon aa they
can get their outfits together. Mr
Cook, yhen asked tbe names of tbe
contractors, asked to be excused from

novices in the art of railroad building,
be seems to have great faith in the
ability of their engineers to pick out a
proper route for bis road, for be has
commenced his grade a the end of
the present rails and is building ac

grade as at present constructed is not
over four feet wide, but Mr Cook states

began operations. Tbe people of
Elgin care little wbo bnilds tbe road ,
or Jty what name it will be known,
bnt tbey in common with ' tbe
people of Wallowa county are

the road. It is tbe railroad they want
and ear little regarding its name or

Tbla morning a temporary injunction
was iasaed by Jndg Eakln and served
upon Mr. Cook, by Deputy Sheriff
Frank Phy, restraining him from tar
thei work until tbe question of owner
ship can be detarminod by the oonrts.
When this waa served, Mr. Cook at

way, but no sooner were the Wallowa
Valley Railway people out of tbe way
than the O R & N Company employe
appeared upon the seen and began
fencing the right of way. About thirty
men each witb a fenoe post upon hli

time a barbed wire fenoe marked tb

A SMALL CHILD
LIVED IN TRUNK

John Mulqneen, aged six years, whose
father has disappeared and whose
mother Is dead, has been living In a
trunk in the alley of bis former home
on Tenth avenue. Tha neighbors saw
