The significance of these terms will appear from the de flations thereof in Bouviers Law Dictionary which reads as follows: under the head "Man datory" 'In the Construction of statutes, this word is applied to such as require to be obeyed, under penalty of having pro ceedings under them declared void. Directory statutes must be obeyed, but, if not, de not invalidate the act." If the court holds the statute quoted a mandatory one the indictments will be quashed, but if the statute is held to be a Directory one, the acts done under Mr. Heney's supervision will be held valid ana the d murrers to the indiotmenl over ruled and the cases tried on tbe facts.
