Hit-and-run suspect found guilty except for insanity WHITNEY WOODWORTH STATESMAN JOURNAL A Salem man who pur- posely struck and killed a pedestrian was found guilty except for insanity and committed to the Ore- gon State Hospital. Dillon Van Diviner was found guilty except for in- sanity of murder and hit- and-run for killing Brad- ley Goad. He was sentenced to as much as a lifetime of ju- risdiction under the Psy- chiatric Security Review Board. According to a mental health evaluation, Van Di- viner, 22, has schizophre- nia. The morning of Dec. 2, Van Diviner was parked along Grant Road near Sil- verton High School. He told police he had just smoked marijuana when he saw Goad crossing the street. Goad, a 45-year-old West Salem construction worker, was on his way to work. Van Diviner told police he felt an “intense over- whelming feeling” that Goad posed a danger to others. He said he needed to get rid of that dan- ger. He sped Van Diviner toward Goad and struck him with his car. Goad died at the scene. Following the crash, Van Diviner drove away, abandoned his running vehicle at the dead end section of Grant Street and ran into a nearby farm field. Officers found him running down done a near- by street. He was arrested and charged with murder, hit-and-run and DUI. During his interview with police, Van Diviner admitted his impairment at the time of the crash was “seven” on a scale of zero to 10. His field sobri- ety test indicated he was under the influence of a controlled substance, po- lice said. Goad’s family said he was known in the commu- nity as a warm-hearted musician, loving father, and adoring grandfather. Born in Salem, Goad Drowning victim at Three Pools ID’d LAUREN E HERNANDEZ STATESMAN JOURNAL The 25-year-old man who died after jumping into the Three Pools rec- reation area has been identified as a student from Linn Benton Com- munity College, accord- ing to officials. Kung Shing Yau, of Hong Kong, China, was last seen jumping from a cliff and into the upper pool of the Three Pools of the Little North Santiam River May 22. Yau was swimming with friends when he did not resurface around 4 p.m. Yau, a student at LBCC in Albany, had been studying abroad in the United States for the last seven years, accord- ing to the Marion County Sheriff’s Office. Kayakers found Yau’s body May 24 and in- formed Marion County Sheriff’s Office. Salem Fire Department and Jef- ferson Fire Department recovered the man’s body May 25. Members of the Clack- amas County Sheriff’s dove into the upper pools of the recreation area to search for the man May 23, but suspended the MARION COUNTY SHERIFF’S OFFICE The Three Pools drowning victim has been identified as Kung Shing Yau, 25. search due to high water and dangerous condi- tions. Between gigs, he worked for a construction compa- ny. In the wake of his death, his family worked to honor Goad’s passion for music and helping oth- ers. They held a memorial concert, where his musi- cian friends played along to a recording of him play- ing the bass, and helped raise money for his chil- dren and 1-year-old grand- son. Two months after the attack, Van Diviner’s at- torney David Kuhns filed a notice of intent to rely on insanity as a defense. He was found guilty except for insanity Wednesday. According to court records, Van Divin- er poses a substantial dan- ger to others and requires commitment to a state mental hospital. North Fork Park, northeast of Mehama, was previously scheduled to open June 1 after a con- struction project to ex- pand and pave the parking lot. Due to weather and construction delays, the season opening has been delayed, Marion County officials said in a press re- lease.
