SO 5 appii- line County Officia Paper ON TRIAL The legal questions involved in the suit of Friendly vs Oleott strike at the very heart of some of the popular ''Oregon Sys tem" laws. This is thesuit wherein Mr. Friendly, one of the Regents of the University of Oregon, is trying to restrain the Secretary of State from placing on the bal lot the referendum of the U. of O. appropriations as passed by the last Legislature, on the grounds that hundreds and per haps thousands of names on the referendum petitions are fraudu lent That there are several thousand fraudulent names on the petitions is admitted by all and it is the contention of the friends of the Uuiversity who are fight ing this case, that faudulent names on a petition invalidates the whole petition, while the contention of the Secretary of State is that those names not faudulent should count, and if there are sufficient bona fide signatures the petition shoula stand. Suppoose the contention of the plaintiff is sustained by the Courts, what will become of the Initiative. Refereudum, and Direct Primary laws? If a fra dulent name on a petition in validates the entire petition it would be almost impossible to secure any initiative laws, to re fer any law to the people or to get a persons name on the ballot at the primaries. It is almost impossible to obtain the signa tures on a large petition without having some that are not legal, not always with fraudulent in tent, but by mistake or inadver tence as well. The outcome of this case will be watched with interest by thousands of friends j of the popular laws in Oregon. THE FRANCHISE The proposition of granting a franchise to II. F. McCormick for a Street Car line in the City is taking all the time and atten tion of the City Council these days. The franchise as proposed covers electric, gasoline and steam power car systems, or either of them, confining, how ever, the steam part to one single line and to transconti nental business, the main part intended to be an electric street car system. It also provides that actual construction work shall commence within two years from the date of its passage and con tinue until at least two miles of trackage is completed and cars running, and shall continue for a period of fifty years. Seve ral objections have been offered, this enterprise should bo given every eneouragomont from the citizens of this community, and no doubt will bo. before it is finally adjusted; but in doing so the council are proceeding with ! caution, looking to the best wel fare of the city in the future as well as at present. While we are a small community and can afford to give in quite consider ably to obtain an enterprise which would be so greatly bene ficial to the city, there "should be certain restrictions along the lines of regulation of fares, rates, street improvements and time. In this connection, one of the pro minent and successful real estate firms in the City of Portland says: We have handled pro-1 perty in nearly every section of . Oregon: have placed thriving, towns where lefore was barren lands and made gardens out of j deserts, but we have never touched Columbia County: We j are going to do some advertising i on our own responsibility and ex-; pect to see that County advance ; as no other county in the State has." i Just another instance of the assured bright future of Colum bia County. While the real estate firms are making money for themselves they are bringing to the atten tion of the people the wonderful possibilities of our county and we will all be benefit thereby. streets over which the proposed line shall run are not designated and steam power. The question lias been thoroughly discussed in the council and it seems that the parties interested are unable to agree and the matter is now hanging fire over these questions. with apparently little chance of agreement. There are several things to be taken into consideration before deciding this important matter. for it is surely important to the future of the city, and we call at tention to some of the more im portant. In the first place. St. Helens is a very small city to be at this time thinking of putting in such conveniences as a street car system; with a population of only about 1100 people it seems that a street car system, local only, would hardly be a paying investment and an undertaking that capital would not care to take hold of; this is indication of bigger things, for while the car line would not pay as a local only, it is quite evident that it will be extended to the outlying districts and eventually to the Nehalem. Such being the case, the council should consider very carefully be fore denying a franchise to bring to this city the trade of the sur rounding country to which it is entitled and which it does not now get. Then again a car system is one of the very best methods of building up more en terprises in a small community, for with the railroads a consider- I auie distance irom the city, as in our case, business and manufact uring establishments will not lo Icate, and a car line put3 them in ciose proximity to the main line of Railroads. Af ter nearly eight years in the Mist office as devil, printer and managing editor it is but natu ral that one should feel sorrow j in leaving the old stand, where ; most of the recollections are very I pleasant. Perhaps this would be a good place to say something of the the changes that have taken j place here in the time I have : been on the Mist payroll. This ( town eight years ago had a , population of about 'U)0, and sec-1 tionsof the city where there arei now nice homes in plenty were; covered with the tall and uncut, j In Lottville there were three j houses and in the neighborhood j of Oasis Park there were 'none, j while closer in the number of I new houses built has been in j proportion. The Courthouse was; a weather beaten frame struc-; ture standing where the plaza1 now is, and there was no city hall. On the site of the big 3 mill was a small plant that only operated a part of the time, and there was no rock crushing plants here at all. It will be a pleasure to come back to St. Helens' some time in the future, and see that progress has made even greater strides than in the past. M. E. Miller will take charge of the editorial work in the Mist and Mrs. ' iiiier wi'l be manager.
