By holding, in a decision rendered today, that the householder's tax exemption is unconstitutional, the Oregon Supreme Court has declared void a statute that ha been in force in tbi state almoat continuously since 1869, Householders' exemptions have been allowed every year except 1004, when Ui exemption law had been repealed, It waa re-enacted by the special session of 1903. but went Into effect too late to be applicable to the assestment of KMX Approximately $8,000,000 has been exempted from taxation in this state from year to year, and legislators, county officers and the people in general have recognized the exemption a valid. Now the Supreme Court ha declared all these exemption as invalid. jnisaecision will make it necessary for County Assessor in many counties to make a re assessment of proerty in their counties lor 1000, for it is the practice of many Assessors not to list property that is exempt. In some and perhaps mott of tbe counties the Assessors list the exempt property and make tbe deductions after ward. in uie case in which this decision was rendered wat a tuit brought In Josephine County by K. C. and E. Wallace, real dents of New Hampshire, against the County Court of Josephine County, to enjoin the allowauce ol householders' exemptions, upon tbe allegation that such exemption imposed upon tbe plain tiffs and all other non-residents an un, equal rate of taxation. The suit was brought by W. C. Hale, who, at representative from Josephine County in 11)03, introduced the bill which repealed tbe exemption clause. The bill patted without ill real purport being generally known. At the tpecial station of the same year the exemption law wa re-enacted but with the stren uous opposition of Hale, who contended that tbe law was unconstitutional. Hale's position baa now been vindicated by a decision of tbe Supreme Court. This case waa decided in tbe Circuit Court upon a demurrer to tbe complaint, the demurrer being sustained by Judge 11. K.
