There seemed to be no question but what the money claimed to be short was never re ceived by the county, whether Muaeie received the benefit of it or not. Grant ing all due consideration to Uie suppoei tion that Mamie was fleeced by persons wiser than himttelf, it seeing to us that tbe blame most attach to someone in order to protect government and prop erty from the acts of officials of dishon est motives or those utterly incapacitated tor the oonduct of business in a business like manner. The law presumes all men to be honest until they are proven o tbe wise. Massie'a utter lack of busi ness qualifications soon found him in a sea of trouble, whether dishonest meth ods hsd played any part or not in plac ing him in the awful predicament he found himself in. But principle is at stake; precedent, dangerous in its antici pation, it the awful consequence of allowing sympathetic sentiment to replace justice. Placing a premium upon defalcation In office encourages others in the path of wrong-doing, no matter by what means the shortage comes about so long as the knowledge of it is possessed by the official. The end of the Maaaie case is not yet. After hve day's time consumed in the courts in an attempt to either convict or acquit the ei-sherilf the status of the case is exactly as it was before the trial in the nreieut term was begun. Almost the entire time was consumed in the introduction of testimony, and on Monday afternoon about 3 o'clock the arsuiuents were began bv the counsel for the state, followed by defendant's counsel, and about 10 o'clock in the nveiiintr the case was triren to the iurv, The instructions of Judge McBride to the jury regarding points of law govern ing a verdict in me case were near ana comprehensive, being positively to the ettect that u it was ot-terminea inai ue- fendant had taken, loaned or converted to his own use any of the fuuds coming into his bands as tax collector, ne was subject to conviction under the laws of this state. The jury upon first ballot stood five for conviction and seven for arquital and thus it stood during the entire time the jury was out aDout twenty nours. At about 4 o'clock Tuesday afternoon the jury returned into court with the written statement of the conditions ex isting. and that no likelihood prevailed that the jury would ever agree upon a verdict, whereupon the court dismissed the jury from further consideration of the rase and from further duty as juror at wis term ol court. District Attorney Cleeton immediately asked the court to set the date for the rehearine of the case, which was done. tbe date being the second day of the October term, at the same time reducing defendant's bond f lutv. Our fire department was called ont last Friday afternoon to stop a slight blaze which had gained a little headway on the roof of the building occupied by Mr. Ed Hillaberry as a barber shop and residence, the fire being fortunately dis covered by Mr. Hillsberry's little boy. Tbe boys responded promptly, and the ore ww quicajy exunguisueu. A letter from Mr. John Beegle, who is at Dyea, Alaska, states he and Mrs. Beegle are enjoying good health. John has a leave of absence fiom his duties at that place for one month, and expects during that time to visit the Atlin min ing country, where he ha interests. The population of Dyea, John says, is now about zuo, wnen a year ago mere were 8000 people there. Nine member of Avon lodge Knights of Pythias, of this city, attended the in stitution of a lodge of that order at Kelso last Friday night. A large number of members from Bainier, aa well aa dele gations from Castle Bock and Kalama, were present. Kalama lodge had the commission to do the work, but were as sisted by members ot tbe order Irom Castle Bock, Bainier and St. Helens. Mneteen voune. brilliant men were cre ated Pythian Knights, and the lodge at Kelso promises to be one ol tne best in the Washington domain.
