Mr. Bumgardner waa a oaller at this office Monday, and imparted a littla information concerning the section of tha (tale where he baa been. He says times are muoh worse there than here, and that tha peach crop, the product upon which the agricultariata depend, i a total failure thia year, and that other fruit and grass crops will be far short of the average. On the 17th of May enow fell in the city of Ashland to the depth of two Inches, snd on the 3d of June a hall atorm lasting fifteen minute, covered the ground an inch deep. Unfortunately, there are do record from whioh to establish a oertain re Ely. Representative Wilkinson, from na county, was supposed to ba the youngest member of the session of 1893. The fisher men' atrike ia over, and once mora op eration at tha canneries along the Columbia river are resumed in a bus!- ness-liks way. The atrika waa declared off by the fishermen', union lt Sat urday, just four daya after tiie arrival of the state militia at Astoria. The bad affects of tha strike, however, will ba felt along the river, and particularly in Astoria, lor a long time, because under preeent condition the whole whole lower river district, both in Ore gon and Washington, ia dependent upon the Ashing industry, and more especially has the atrike been hurtful thia year for the reason thst for the paat aeveral weeka aalmon bava been running in targe numbers, and hun dreds of man who might bava been making good wages hava not bsen permitted to da so, at tha same time having gone further in debt for the neceeaariea of life. Had the militia ben aent to the lower river when askod for a month ago, livea to the number ot ten or fifteen and property valued at thousand of dollars, would hsve been saved. It must be remem bered that the state troops on their ar rival at Astoria did not attempt to in timidate tha striken, but their pres ence there was a warning to the law leee element that they could no longer murder boneit citiaena and destroy their property at will. When tbia waa prevented the strikers no longer bed any hopes of suocess, and very soon began to call at tbe canneries for thsir fishing gear. The price being paid for salmon ia 4g cent per pound, which the union at Ant refused, but two days later agreed to accept. It is to ba hoped no further trouble will oc cur. 'DLX' v CREAM Moat Perfect Made. 40 Year the Standard. HELD TO TBE GRAND JURY Bice and Looney Required to Give Bonds. The Alleged Mismanagement of a Trust Fund Ha Got Them Into Serious Troable. (From tb Portland Tslegram, June 30.) From th evidence adduced during th two day' preliminary examination of Lawyer W, J. Rice and Schoolmaster J. P. Looney, for tb alleged larceny by balls of I lino, from J. E. and Emeline Van Carnap, Juat lea Oaialer fait warranted In holding thsa to tb grand Jury. Three years go tb Van Carnap. hus band and wife, bad a littla domestic tronbl. when RIc tppesred upon tb soene s Mrs. Van Carnap's legal advisor. This man. learning that th eon pi were possessed of some valuable joint Interest in Wasli lngtnn county, evidently with a slnl-ter motive temporarily aggravated the couple' estrangement by suggesting to Mrs. Vsn Carnap that ah institute divorce proceed ing. A a preliminary step, to avoid court entanglements, should the snit come to an Issue, the Van Carnap agned te dis pose of their Washington county realty holding, by sale, divide the proceeds among themaelvea, with th eioeutlon of 11200, to be aet aside aa a trust fund, from the reve nue of which the cxpenae of the tuition of th Van Carnap children was to be de frayed. As already stated In these columns. Rice cleverly engineered thl scheme, and had himself appointed trustee of th I12U0, drawing np tbe contract in lb loosest os slbl manner, which wa shown in court, and, according to other testinony. In order to make this story complete, tba fact must b republished that th day following th execution of this flimsy contract, Vsn Carnap and Bio were coming hrre from 6h Helen on itoemboat, when th tor, mer wa engaged in conversation with Schoolmaster Looney. This man so im- C rented unsophisticated Van Carnap with i high, order of integrity by bis professed f rominence in school and church circles hat before th boat reached thl city Looney had become a oo-truatee with Rice. Tbe atory of tbe schoolmaster' perfidy by hi own confession, was briefly narrated In last evening's Telegram. But Rice re lated the atory of his sbar in tb affair later yaaterday afternoon. Rice claimed that th 800 of th (poll he retained after giving the cboolmastor hi part of tb misappropriated 11200, be regarded aa a personal obligation to th Van Carnap. Thia man frigidly confessed tbat he baa no Interest In th Van Carnap children or any other. Ua claimed to bav paid out $75 for his ward, but railed to mak a showing of more than B25. Tbe balance Rice ' Mew in" on hi own account. He further testified tbat be had not spoken to hi "co-truste" for two yeara prior to their recent arrest He mad no explana tion on that point, but tbe Inference waa tbat the "trust fund" might bav had eomething to do with th disturbance of tbeir friendly relation. Daring this defendant' cross-examination, be eeaaved to eonatrn th term of tb contrast creating tb treat in a manner to nt bia own caae, wnereat justio ueisier severely eat down upon Rice, atating tbat tbe court waa aafflcientlv Intelligent to un derstand th purport of that document without th defendant' tntarpratauoo of It. Counaei for the defena tried to make it appear that tha 11200 placed la tb banda of the defendants wa merely in the form of a slmpls loan, and tbat Rice and Looney could not. with tbat understanding, be subjected to criminal prosecution. Th court, however, differed from counaei. holding tbat tba uteraJ and legal construc tion of the contract evidenced tb 11200 ad vanced to the defendant by tb Van Car nap to have been a trust fund pure and simple, to be devoted to the education of the Van Carnap children only, unless or until a court In equity dissolved th trust. Tb court held Rice and Looney to th Brand jury ia bonds of tlOOO. vni luiervsung nnaae 01 tnia taiv tcs re maining to be told ia that, after all, th Van Carnap divorce suit never had a day in court, and th subject, perbapa, never would have auggeated itself to them, but for outaid interference.
