University graduate fights deportation By Sarah Kitchen Of Ihff Kmprald A 1981 University graduate is facing deportation under the McCarthy-era McCarran-Walter Act, and his fight to remain in the United States is gaining the attention and the support of newspapers and well-known personalities. khader Hamide is traveling around the country spreading a message that the McCarran Walter Act is a threat to the First Amendment rights of every in dividual. He will be speaking at the Temple Beth Israel tonight at 7:30. Hamide. a Palestinian and a permanent resident of the llnited States, was arrested on January 20. 1987 in Los Angeles by members of the FBI. the Im migration and Naturalization Servicui and Los Angeles police. Also arrested were riamiue s wife, who is a Kenyan citizen, and five other Palestinians. On February lf> another Palestinian was arrested. The government claims those arrested arts a threat to national security and is Irving to deport them under the McCarran Walter Act, which makes affilia tion with an organization that advocates worldwide com munism a deportable offense. Hamide was arrested for possession of a magazine, he said. All the Palestinians were arrested under the same charge. On May H the eight went to trial, and on May It the judge dismissed the case because of insignificant participation on the part of the government. Hamide said. “She dismissed the case because the government refused to bring to court the man who signed the arrest warrant." Hamide said. "He gave no reason for not attending, he just said he is not coming." The day after the case was dismissed the government issued new arrest warrants for the eight people, and another court date has been set for june 2fi. "The government selected us on the basis of our nationality and our opinions about the Mid dle Hast." he said. "We ad vocate. as Palestinians, that we would like to see Palestinian rights achieved for the homeland and the Palestinian state." he said. "The INS an? insisting that we an: a national security threat and that we should not t>e let out on bail, and that all the evidence against us should be presented in secret and not in public." he said Through this case, Hantide said, the U S. government is trying to set a precedent regar ding deportation, first within the Arab community and then within other communities. The McCarran-Walter Act also limits freedom of speech and dictates who can and can't practice the rights guaranteed by the First Amendment. In said.
