However, form in# a special district creates legal problems, said David Whitlow of Eugene's city council office. "By law if a special district is created, other services could be added." Whitlow said. "I'm having a difficult time deciding whether there’s another problem the city has not stated." Rogers said "I can’t believe there's any worry with the city.'' Rogers accepts the fact of pro liferation of service districts, but said the Hoard of Commis sioners would be the governing body of the special district. Me said the commissioners would have no reason to add another service to the proposed district. Two alternatives are possible, according to Whitlow, One is restricting the ballot title and making sure the ballot language is worded properly. Another alternative is an intergovern mental agreement that would forbid other services from being added. The Lane County Local Government Boundary Com mission also must approve the proposed district. The boon dary commission is a state com mittee approved by the gover nor with veto authority.
