A preliminary analysis from the Office of
Student Advocacy (OSA) concerning Law
Dean Chapin Clark’s decision to limit law
library usage to law school students, indi
cates his ruling was valid.
Early last month, Clark closed the library
to non-law students, citing stolen coffee
money, excess noise and messes left in
classrooms as the basis for the closure.
The library is still open to non-law students,
but only those engaged in research with
materials obtainable at the law library.
ASUO Pres. Gary Feldman called the
decision unfair and asked for the OSA re
port. That report states Clark clearly has the
authority, as delegated by the State Board
of Higher Education and University Pres.
William Boyd, to determine what use the
facility should have.
The report continues that any appeal on
that decision will have to go to Boyd or to the
state board. One challenge to Clark’s pol
icy, however, may be that it was not prom
ulgated under the administrative procedure
act.
Also, persons who feel their rights have
been revoked, could instigate a contested
case procedure. OSA Director Don Chal
mers says the first step would be to take a
complaint to Boyd and if he refuses to act, to
then take it to the state board.
Chalmers says course of action might be
to work with Clark to expand his ruling. He
says a “more reasonable policy’’ might be
enacted so “any student engaged in legiti
mate use of the law library will be allowed to
stay.
“We re trying to find some way that seri
ous students can have a space with
specialty documents available to them,”
says Chalmers. Yet, he says “it seems
there is at least a rational basis that it (the
library) not be a general study hall.”
The objective is to ‘establish a regulation
that will accomplish Clark’s purpose without
excluding all undergraduates from the law
school premises,” says Chalmers.
