Handicapped rights focus of workshop By JOHN LUDWIG Of the Emerald Part of the 1973 Rehabilitation Act is essentially a “Bill of Rights,” for the handicapped, Marion Sol oman of the Seattle HEW Re gional Office for Civil Rights said Saturday at a “How-to Workshop” for handicapped citizens of Eugene-Springfield. The workshop, sponsored by the Eugene Commission on the Rights of the Handicapped, was part of the commission s continu ing effort to provide educational workshops, to identify the percen tage of handicapped persons in the population and to channel dis crimination suits for the handicap ped to the three human rights specialists working for the city manager, explained Carol Johan - sen, the workshop coordinator. Solomon told the workshop au dience what Section 504 of the 1973 Rehabiliation Act means, both to the handicapped and to the institutions receiving HEW funds. “Any program receiving fi nancial assistance from HEW, in cluding elementary and secon dary schools, colleges, hospitals and social service agencies, must comply with Section 504 to con tinue receiving money.” One of the “key issues” is “program accessibility,” she said. Under this regulation, all buildings must be architecturally accessible to the handicapped. Not all buildings must have elevators, but classes normally of fered on the second floor should meet also on the first floor. “In order to gain program ac cessibility,” said Solomon, “a total program change is necessary in regards to toilet facilities, drinking facilities, pay phones and parking lots.” Each program must now comply with Section 504 building regulations or have on its files a “transition program” that states the problem, solution, course of action and time-frame in which the problem will be corrected. This file, which was to be completed by Dec. 2, last year, will be main tairied for the next three years, at which time compliance will be mandatory, she explained. "University libraries,” Solomon said, "are required by section 504 to provide aids who are available to assist the handicapped with re corders and Braille literature. Special assistants in certain academic areas will also be re quired, such as writing assistants, chemistry lab aids, aids at the re ception areas of some buildings and interpreters for the deaf. ‘‘Employment discrimination is another facet of 504," Solomon added. ‘‘Employers may not re fuse to hire or promote handicap ped persons solely because of their disability. Also, employers will be required to make reasona ble accomodation’ for handicap ped employees.” In order to meet “reasonable accomodation” requirements, she said, employers may be faced with some expenses. The HEW wili look at the budgets of emp loyers to determine how much can be put into “reconstructing" job situations to meet the needs of the handicapped.” In some cases re construction’ may mean nothing more than lowering a desk for an employee confined to a wheel chair,” Solomon explained.
