D*A. testifies in suit challenging election By JQSH MARQUIS Of the Emerald Lane County District Attorney Pat Horton took the stand on his own behalf for several hours Tuesday during the second day of a suit challenging his recent election to the post he now holds. The suit was filed by Donald Armstrong, law clerk to Roy Dwyer, who is representing Armstrong in his suit against Horton. As the hearing began its second day before Judge Richard Mengler of Benton County Circuit Court, Dwyer called former deputy district attorney Steven Keutzer who testified that he refused to work under Horton because of the way Horton’s campaign was conducted. Among the charges brought against Horton by Armstrong were allegations that Horton had improperly solicited bank loans to finance his campaign, misrepresented certain facts in his campaign literature and improperly distributed free balloons to voters. Responding to the charge regarding loans, Horton testified that he had informed the bank he would be using $2000 of the $3000 loan to help finance his campaign. State law prohibits banks from contributing to political campaigns. Armstrong also alleges that Heaton violated state election laws that prohibit the giving away by a candidate of “things of value.” Horton responded that he had initially distributed balloons free of charge after consulting the Oregon Revised Statutes but that he sold them after he was told by the secretary of state’s office the practice of giving the balloons away was not permitted. Dwyer brought into evidence several different ads run by the Horton campaign committee in the Emerald where Horton stated he would, if elected, issue “traffic ticket like citations” for drug users. Dwyer charged Horton had no intention of doing this. Horton responded that he referred to misdemeanant citation, a procedure whereby an officer may issue a citation, or written order to appear in court for certain misdemeanors. Horton testified that he had every intention of instructing Lane County law enforcement agencies to utilize the citations, where applicable, in place of arresting persons who were likely to appear for trial. § 5SSSSSS' Fuller... He is presently exploring the possibilities of using wind as an efficient and inexhaustible source of energy. He explained that if one minute of one hurricane could be harnessed, the energy would surpass the power of the combined nuclear arsenals of both the United States and Russia. Fuller looks to the windmill as a means of har nessing the energy of wind. He said he is using the aeronautical knowledge of the last 50 years to design new, efficient windmills. Fuller is a self-made crusader of maximum efficiency. His mind is complex, operating on so many different levels the listener is often left confused and bewildered. But the emphasis on efficiency, on maximum utilization, remains in everything he says.
