‘Butterfly’ backs out of concert Rock group “The Iron Butterfly,” scheduled for a concert at the Eugene Speedway at 8 p.m. Wednesday night, cancelled out an hour beforehand. Reasons for the group’s cancellation were: • They didn’t like the facilities at the speedway. • They didn’t want to take the chance of having their equipment ruined in case of bad weather. Lane Community College’s student body was sponsoring the concert. LCC student president Warren Coverdell said Thursday that Iron But terfly “was unhappy in a general sense with the speedway as the site” for the concert. Coverdell added, “They have over a hundred thousand dollars worth of equipment and didn’t want to take a chance that it would rain.” About 1000 persons turned out for the concert and had to be turned away, LCC student senator Doug Strong said. For those who had bought tickets for the concert, Coverdell said the tickets were valid for a concert appearance by the Butterfly Thursday night in Portland. Also, money paid for tickets will be refunded, a student senate spokesman said, but the time and place for refunds are not yet set. Coverdell said the LCC student body plans to get “some legal opinions” in the near future as to whether the rock group can be required to live up to the contract made for the speedway performance. That contract stated that the Butterfly was to be paid a guaranteed $1300 from advance ticket sales and 85 per cent of the net take at the gate, Coverdell said. Arrangements for the concert in cluded a stage which was to have been two flat bed truck trailers put together. The Butterfly “didn’t think it would be suitable for their equipment,” Coverdell added. ATO fraternity may be liable for co-ed’s 1964 injuries SALEM (AP)—The Oregon Supreme Court has found that Alpha Tau Omega fraternity at the University may be liable for auto accident injuries suffered by Jane L. Wiener. Miss Wiener had attended a party sponsored by the fraternity at which liquor was served. On her way home in a car driven by David Blair, a minor, Blair’s car hit a building and Miss Wiener was injured She sued the fraternity, Country Squire Recreation Ranch, where the party was held, and Daniel H. Kienow III. Kienow had bought the liquor for the party. Lane County Circuit Judge Edward Leavy had found in favor of the defendants. The Supreme Court agreed that Kienow and Country Squire Recreation Ranch should be released from possible liability. It said that Kienow wasn’t in volved in the decision to allow minors to drink, and that the owners of the Country Squire tree farm had no duty to supervise the party. But the court said the frater nity had control over the party and decisions relating to the event, and a jury could conclude that Alpha Tau Omega was negligent. The case was remanded for trial Walkers for Development may turn in money Saturday Walk for Development par ticipants may turn over the money they have collected to the Eugene Branch of Citizens Bank, 190 E. 11th Ave., on Saturday. The bank will be open only for that purpose from 11 a m. to 2 p m Saturday Dave Bartel, one of the May 8 Walk coordinators, said all those bringing their money must also bring their “Walk cards” with them, or at least know the number of their cards. The in formation is needed to facilitate the deposit of the money, as well as to check on the amount collected Items lost on the 34-mile walk ranging from shoes to dental retainers, may be claimed at the bank Saturday. Those who can't get to the bank Saturday may turn their money into the hank the following week during regular banking hours The hunk is open from 10a.m. to 5 p m Monday through Thursday, and until 6 p in on Friday If sponsors have not been contacted by their walkers, they may call the Walk office from 3 to 6 p m throughout the week to turn in their money The office is at 608 Willamette St.; its phone number is 342-7276. A dance will be held Sunday from 2 to 5 p.m. for all persons who participated in the Walk. The dance will be held in the Eugene Mali’s plaza area, and live music will be provided. SEARCH class builds houses Several government officials have been invited to the Monday night meeting of the SEARCH class, ‘‘Home-Made Houses, Action Now." The class has also invited representatives of various regional and national housing agencies providing assistance to low income families to attend the meeting Students in the course have been working with several community organizations building and repairing homes for low income and minority families. Their work is supported by donations of building materials and government aid in the form of grants and low interest loans. At the meeting 7 p.m. Monday night in 302 Gerlinger Hall, the class will use visual presen tations and models to explain Action Now's projects to the visitors Miss Wiener, who was a University freshman at the time, suffered a severed spinal cord in the accident and has lost the use of her arms and legs.
