Goldmark Jury Rejects Right-Wing Theory By DAVE SANDS Emerald Staff Writer A victim of a right-wing smear campaign told a University audi ence Friday night his suit for li bel forced the defense to “put its whole theory before a jury — and the jury rejected it." John Goldmark, a 46-vear-old Washington farmer and former member of the Washington legis lature, told his 100-person audi ence that when he sued four Okanogan. Wash., men for tell ing voters he “was under Commu nist party discipline" the defense chose to attempt to convince the jury anybody opposed to the rad ical right must be taking orders from Moscow. "That was our worst sin—we were opposed to the radical right,” Goldmark said. He won the trial and a $40,000 judgment, now being appealed. Word-of-mouth Campaign The trial, in the fall of 1963. j arose from the activities of the group of men during the 1962 primary, but a word-of-mouth campaign against him had be gun the previous year, he said. One of the defendants in the trial somehow got secret House Com mittee on Un-American Activi ties testimony given by Gold mark’s wife Sally to use against her in the campaign, he said. The smear began against Mrs. Goldmark, stressing her mem bership in the Communist party in the 1930s. and later swung to Goldmark because he was a Liberties Union (ACLU), which Liberties Union (ACLO), which they alleged was a "Communist front.” ‘Moral Force of Freedom' The Harvard law school gradu ate stressed the "right to dis sent” in his speech. Citing a JBS “joke" which had as its punch line "JFK should be assassinated” told at a Seattle JBS rally in the summer of 1963, and the advertisement appearing after the assassination stating the President's death was due to Communists, as examples, Goldmark said the Society talks out both sides of its mouth. The John Birch Society is mon olithic, its tactics are Communis tic, and its effect on elected offi cials is "terrific," Goldmark said. His defeat in the primary was laid to the smear campaign against him and his successful suit was filed after it.
