Is it follows, to-wit: IN THB COUNTY COURT OF THE STATE OF OREOON FOR DOUGLAS COUNTY ORDER SETTING FORTH BOUNDARIES AND SETTINO ELECTION OATI In the Matter of the Proposed Incorpor ation of Additional Contiguous Territory as a part of ROSEBURG RURAL FIRE PROTECTION DISTRICT OF DOUGLAS COUNTY, ORE GON T nis matter coming on regularly for hearing before the County Court of Doug las County, Oreqon. IT APPEARING TO THE COURT that heretofore on the 30th day of March, 1961, this Court made end entered en order declaring Its Intention lo hold a hearing upon the proposed Incorporation of addi tional contiguous territory as particularly described in said Order as a part of Roseburg Rural Fire Protection District of Douglas County, Oregon, and by said order did cell a hearing before tnt Court on the ?nd day of May. 191, In the County Court Room In the Douglas County Courthouse In Roseburg, Oregon, at 10;00 o'clock a.m. on said date. That notice of said hearing and the time and place so fixed was duly given by publication In the Roseburg News Review, a newspaper of general circu lation in said territory, there being no news paper published within said Fire Protection District or any of the Units proposed to be annexed; That said notice was published In said newspaper In the Issues of April 7, 14, and 21 of 1961 as more fully appears from the Proof of Publication on file herein; Said Petitions proposed the incorporation ef additional territory as a part of said Fire Protection District, commonly referred lo in the Courts order above set forth as Units "A", "C", "C", and "D"; end IT APPEARING TO THE COURT that at the hearing thereof held on the 2nd day of May. 1961, at the time and piece as aforesaid, there were obections made to the Inclusion of portions of said Unit "B" and "0"; said objections being In particular as follows: 1. Mr. J. W. Holmgren, being the owner of at least a portion of the South half of the Southeast Quarter of Section 34, Township 38 South, Range West, objected to the inclusion of the said portion within the Fire Protection District on the basis lhat the said ares was primarily hill, pasture, and brush land and was more readily adapted to fire protection by the Douglas Forest Protective Association. Tne Court was of the opinion that there should be excluded from the proposed Incorporation that part of Unit "D" described as the Southwest Quarter of th Southwest Quarter of Section 19, Township 21 South, Range 5 Wesl, Wlk lamett Meridian, together with that portion of the Southeast Quarter of the Southwest Quarter of said Section 19, Included within the description of Unit "D" and also the South half of the Southeast Quarter ol Sec lion 24, Township 21 South, Range Wesl, Willamette Meridian. 2. Messrs. Parley Ware, Waller Welker, end Ora Welker presented a written objec tion to the Court asking for the exclusion from Unit "B" of their lands particularly described in th Exhibit "A" lo their written objection filed with the Clerk herein. The Court was of the opinion that the objection ot Messrs. Ware, Welker, and Welker were well taken and that said area as described in their objections should be excluded from Unit "B" of the proposed Incorporation. NOW, THEREFORE, IT IS HEREBY OR DERED that a Special Election be held on the 6th day of June, 1961, at place within each of the proposed Units "B", "C", and "0" (or annexation, said place to be select ed by the County Clerk and that there be submitted to the qualified electors within each of fh Units "B" "C", and "O" proposed for annexation, and also within the present boundary of the Roseburg Rural Fire Protection District, the question of in corporation ot each of the additional terri tories, fo-wlt: Units "A", "B", "C", and 'D", hereinafter particularly described as a part of the Roseburg Rural Fire Protection District of Douglas County, Oregon ; That the Units so proposed tor annexation as a part of the existing Roseburg Rural Fire Protection District the boundaries of which ere hereby chanqed by reducing the area thereof by excluding the portions ol Section 19, Township 28 South, Range 5 West, and Section 24., Township 21 South, Range 6 West, as above described, from Unit "D" and also by excluding from Unit "B" the vVare and Welker prooerties particularly described in the objection filed by said Darley Ware and others above referred to. That the Units so changed for the pro posed annexation as I part of the Roseburg Rural Fire Protection District ere described as lot lows: A. Unit "A", commonly referred to as Part of Roseburg Orchard Company Piaf 1, Tract I, and as described in Exhibit "A" attached herelo and made a perl hereof. B. Revised Unit "B", commonly referred to as Garden Valley - Del Rio Area, and as particularly described In Exhib it "B" attached hereto and made a part hereof. C. Unit "C", commonly referred to as East Green Area and as particularly described In Exhibit "C" attached here to and made a part hereof. D. Revised Unit "D", commonly referred to as Glengary Area, and as particu larly described in Exhibit "0" attach ed hereto and made part hereof. That all of tnt owners and holders ef real property within said Unit "A" Petitioned for annexation and no election it necessary within said Unit "A". IT IS FURTHER ORDERED that the County Clerk shall appoint three Judges i and three Clerks for election for each of said f Units "B", "C". and "0", and within the j boundary of the Roseburg Rural Fire Pro-j tection District; name the piece for holding : of such election within each of said Units !
