That on January 28, the Slate Supervisor, Bureau of Land Management, whose address is 809 N. E. Sixth Avenue, Portland 12, Oregon, filed in the Land Office, of the Bureau of Land Manage ment,' Department of the Interior, at 809 N. K. That if any person claiming or asserting under, or by virtue of, any unpatented mining claim lo cated prior to July 23, 1955, any rich!, title, or interest in the vege tative surface resources and other surface resources, under such min ing claim, contrary to or in con flict with the limitations or re strictions specified in section 4 of said act, as to the above-described lands or any part thereof, shall fail to file in the Land Office of the Bureau of Land Management at 809 N. E. 6lh Avenue, Portland, 12. Oreson. and within 150 days from the below-slated dale of first publication of this Notice, a veri fied statement which shall set forth as to such mining claims: (1) The date of location; (2) The bonk and page of re cordation of the notice or certifi cate of location; (3) The section or sections of the public land surveys which embrace such mining claim; or if such lands are unstirveyed either the section or sections which would probably embrace such mining claim when the public land sur veys are extended to such lands or a tie by courses and distances to an approved United Slates min eral monument; (4) Whether such claimant is a locator or purchaser under such location; and (5) The name and address of such claimant and names and ad dresses so far as known to the claimant of any other person or persons claiming any interest or interests in or under such unpat ented mining claim; such failure shall be conclusively deemed -(i) to constitute a waiver and relin quishment by such mining claim ant of any right, title, or interest under such mining claim contrary to or in conflict with the limita tions or restrictions specified in seclion 4 of the Act of July 23, 1955 (69 Stat. 367). as to unpat ented claims located afler that dale, and (ii) to constitute a con sent by such mining claimant that such unpatented mining claim shall he subject to said limitations and restrictions, and (iii) to preclude thereafter, prior to issuance of pat rol, any assertion by such mining claimant of any right or title to or interest in or tinder such min ing claim contrary to or in con flict with said limitations or re ad rirtions. Section 4 provides, gen erally, that unpatented mining claims located afler July 23, 1955 shall not he used for purposes oth er than prospecting, mining, or processing operations, or uses rea sonably incident thereto; that such claims will be subject to the right of the United Slates to manage and dispose of the vegetative sur face resources thereof and to man age other surface resources there of; and that, except to the extent required for mining operations and uses reasonably incident thereto or to provide clearance for such op erations or uses, claimants of such claims shall not use of dispose of vegetative or other surface re sources thereof: and that, except for clearance for such purposes, any permitted severance or re moval of timber must be in ac cordance with sound principles of forest management. Said section 4 also provides that any use of the surface of any such mining claim by the United Mates. Us permit tees or licensees, shall be such as not to endanger or materially in terfere with the prospecting, min ing, processing or reasonably in cident uses by the mining claim ant.
