Morton Sobell Loses Two More High Court Appeals MUST WED 2-24 Morton Sobell WASHINGTON I Morton So bell lost two more appeals to the Supreme Court Tuesday from his 30'year sentence for wartime es pionage. The high tribunal refused to act on allegations by Sobell that (A) he was kidnapped in Mexico by U.S. agents and illegally brought back to face espionage charges, and (b) his conviction was "steeped in fraud and tainted by false and perjured evidence." Without comment the court re jected both appeals. This was the eighth time applications of o n e kind or another on Sobell's behalf bave been turned down. Hits Movie Censors ' In other actions the Supreme Court: 1. Cracked down for a third time on movie censorship by reversing the ban imposed by Chicago's po lice censor board against show ing of the French film "The Game of Love." The reversal, or dered without the customary hear ing of arguments, was in line with 1952 and 1953 Supreme Court de cisions. 2. Unanimously set aside the conviction of Alvaro Alcorta, who was sentenced to die in Texas for fatally stabbing his wife. The court held that Alcorta, 28, was not given due process of law at his San Antonio trial because the prosecutor withheld information that the wife had been intimate with the state's principal witness. Agreed to review decisions that Federal Trade Commission authority over accident and health insurance firms i s limited to states that do not have adequate laws against false advertising. FTC appealed from decisions by U.S. Circuit Courts in Cincinnati and New Orleans. The court disposed of Sobell's appeals in a brief order which noted only that the court would not act on them. Ptrmitttd Filing of Brief The tribunal did permit the fil ing of a "friend of the court" brief urging that Sobell be granted a review. The brief was prepared by attorneys who said they acted in behalf of some 5,300 persons. A list of names included that of Dr. Harold C. Urey, atomic sci entist. Sobell was convicted in 1951 as a member of the Rosenberg atom ic spy ring. Ethel and Julius Ros enberg, convicted with him, were executed in June, 1953. Sobell is now serving his eighth year in Alcatraz penitentiary. On Oct. 28, the supreme court rejected a Sobell petition asking that the tribunal reverse itself and grant a review of his conviction. Solicitor General J. Lee Rankin opposed any affirmative action on the two appeals denied Tuesday. The brief recalled that Federal Judge Irving R. Kaufman of New York had studied Sobell's allega tions and in June, 1956, found them without merit. 67 Penguins Loaded Aboard Globemaster MCMURDO SOUND, Antarctica i Sixty-seven penguins, des tined for new lives in scientific laboratories and American zoos, were loaded aboard a U S. Air Force Globemaster Tuesday. The penguins most of them headed for Portland, Ore. are the largest collection ever to leave Antarctica and the first to go by air. They were captured by Jack Marks, director of the Portland Zoo, and U. S. Navy personnel during the last few weeks. There are 31 emperor penguins, weighing about 60 pounds each and stand ing about 3 feet tall, and 36 of the smaller adelies. The Globemaster is scheduled to arrive in Christchurch, New Zea land, Wednesday morning. After stops at Nandi Fiji in the Pacific and Honolulu, the penguins will ar rive in Portland Thursday after noon. Six of the emperors are des tined for the San Diego Zoo and 12 are going to Dr. W. J. L. Slade of Johns Hopkins University. King Hussein struck back at the Egyptian propaganda attacks over the weekend. He said Sunday Egyptian leaders had "sold them selves to communism and exploited Arab nationalism to divert Egypt ian public opinion away from the I deteriorating situation at home. Half or more of Jordan's popu lation is composed of Palestine Arabs, people easily stirred by any hint that their claim to their old homes in Israel might be sac rificed in a peace settlement. Controversial Minister Passes At Wichita Home WICHITA, Kan. i Dr. Ger ald B. Winrod, 57, militant and often-times controversial minister and religious publisher, died at his Wichita home Monday night. Ho. was a member of the Baptist Church. Best known of his relig ious publications was "The De fenders." although he was a pro lific writer of pamphlets on re ligious and historical subjects. Campaigning bitterly against the New Deal, Winrod staged an unsuccessful bid for the Republi can nomination for U. S. senator from Kansas in 1938. He lectured and preached in every state, and traveled exten sively in foreign countries. Federal District Judge Sylvester J. Ryan sentenced Miss Torre to 10 days imprisonment but re leased her in her own recogni zance pending an appeal. "I sympathize with you," said Ryan, "but your position is im properly taken and you have no judicial support." Miss Torre had been called as a witness in a pretrial examina tion of a $1. 393,333 breach of con tract and libel suit brought by Miss Garland against the Colum bia Broadcasting System. Miss Torre refused a court order to reveal the name of a CBS execu tive who allegedly furnished infor mation for an article she wrote last Jan. 10. Commenting on her refusal to reveal her news source, Judge Ryan said: "The process of the court must be obeyed, notwithstanding the high motives wnicn nave prompted you to act as you have." The judge, who had told Miss Torre in several previous hearings in the case that he must find her in contempt, as the law now stands, asked her if she still refused to name the executive. For Reasons already submitted in the papers," said Miss Torre, "I must respectfully decline." Mathias Corrca, Miss Torre's at torney told the court the Herald Tribune would carry the case to the U. S. Supreme Court, if neces sary, to obtain a ruling on wheth er a reporter could be forced to reveal his source of information. DECLARED INELIGIBLE SALEM (1 Legislators are ineligible to serve as paid em nlnves of lesislative interim com mittees, Atty. Gen. Robert Y. Thornton ruled Tuesday.
