Limited Stock Market Rally Fails To Last NEW YORK A limited rUy in the slock, market petered out in the afternoon Tuesday leaving pncei mostly down frac tioni to around two pomta a ahare. The market went into a quiet decline after an eventful morning in which the high speed ticker tape twice Jell behind the pace of trading. Monday's decline was the worst iince October, 1955. Based on Associated Press av erages, Monday's nosedive clipped about four billion dollars from the quoted value of all stocks listed on the New York Stock Exchange. The decline was generally de- acriuca as purely lecnnical. Brok ers said the market was seeking a new low level that could prove attractive to buyers. In the background, however, were a number of developments, which indicated a tightening up of the economy. The declining market was given fresh impetus a week ago when former Presi dent Hoover said the current in flation showed possibilities of fore shadowing another depression. Some brokers have been advis ing investors to proceed with cau tion and have suggested that a mild business recession could oc cur later this year. Contempt Of Congress Conviction Is Upheld SAN FRANCISCO 1 The con tempt of Congress conviction of Herbert Simpson, Portland, was upheld by the U. S. Court of Ap peals here. Simpson, who tried to use the Fifth Amendment to avoid an swering questions put to him by the House Un-American Activities Committee at hearings in Port land several years ago, was sen tenced to 10 months in prison and fined $250 by a federal district court. . The appeals court said answers to such questions as his residence and educational background were not such that he would incrimin ate himself by answering.
