Law Firm Files
Suit Against
Naming Justices
SALEM '.f A Portland law
firm filed suit in the state Supremo
Court Wednesday contending that
the high court has no power to
appoint circuit judges as tempo
rary Supreme Court justices.
In the past few days, the Su
preme Court has so promoted
Ihree circuit judges to the hiuh
bench to serve temporarily. They
are James W. Crawford, Portland;
Kalph M. llolman. Ore -ion City;
and Dal M. Kin, Cociuille.
Maguire, Shields. Morrison and
Bailey, the Portland lawyers, ar
gue (hat (he iy.5 law, under which
(he appointments are authorized,
is unconstitutional.
The firm points out that the Con
stitution says that supreme justices
must be elected by the people, or
appointed by the governor when
vacancies occur.
This provision, the Portland law
yers contend, means that the Leg
islature can't provide any other
method for placing judges on the
supreme bench.
The Portland firm is interested
in a ease in which Judge Craw
ford Is to sit on Thursday.

Smith is now at home following

Mrs. Hamilton is also a sister of
Mrs. H. (i. Kreeman who resides
on Stlksdorf Street in Winston.

to Oregon.

Supreme Court decision involving
Oregon threatens the traditional
water rights of the IS Western
reclamation states.
Because of this, he said in a
statement, he has introduced a bill
In clarify and reaffirm these
rights.
"Traditionally." he a a id, "the
federal government in the 17 West
ern stales has acquired and held
Us water rights under stale law
as a proprietor, just the same as
any other land owner.
"Under the decision in the Ore
gon case, whenever the federal
government reserves a portion of
the public domain for a military
installation, or any other specific
purpose, the use of water on the
reserved area would be independ
ent of stale law.
"If this decision is applied re
troactively, it could cut off private
water rights which have been in
use for half a century or more."
Pointing out that Uie government
owns larte areas of the West,
Knele added:
"The complexity and disastrous
impact of this decision in such
circumstances can he easily seen
and it is therefore imperative that
the decision be reversed by act of
Congress."
