The hiiih court made its ruling In denyinii the petition of Claude Castle, polk County habitual crim inal, who sought his release. He was sentenced in Polk County for livestock theft to three years. Because it was nis lourtn convic tion, he also was sentenced to life as an habitual, criminal. Castle contended that the sen tencing judge had no right to give him both the three-year and life sentences. The Supreme Court, in Its de clsion by Justice Hall S. Lusk, said the Circuit Court was required to give the life sentence, but that it shouldn't have meted out the three year sentence.
