Fair Trade Act's Validity Upheld By High Court WASHINGTON (JB The Su preme Court Monday rejected a challenge to validity of the federal McGuire act, which puts teeth into the "fair trade" laws of 45 states. The McGuire act permits manu facturers .. to specify the retail prices at which their products are to be sold in each of 45 states They may do so if a single retailer in any state signs a pricing agree ment. It then is made binding on all other retailers in the slate, in cluding those who do not sign. All of the states except Texas, Missouri, Vermont and the District of Columbia have "fair trade" laws. Constitutionality of the McGuire act, as well as the Louisiana "fair trade" law, was attacked by Schwegmann Brothers Giant Super Market of New Orleans. Schwegmann appealed to the high tribunal after the U.S. District Court in New Orleans ordered him to sell insulin made by Eli Lillv and Co. at the state "fair trade" price of $2.83. Schwegmann had been selling for 75 cents less. The U.S. Circuit Court in New Orleans- in upholding the District Court said both the Louisiana "fair trade" law and the McGuire act were constitutional. Schwcg mann's appeal contended: "This decision will have an im mediate and continuing effect on the millions of consumers in fair trade stales, who today are paying more for the goods they buy than they would pay for the goods in a free competitive market. Fair trade strikes at distinctively American ideas: The Sherman act philosophy of competition as es sential to .democracy; the little man's faith in individual initative; the American ideal of continually rising standards of living achieved b y merchandisi n economies passed on to consumers; the writ ten constitution as a shield against overreaching legislation." Jordan Minister Will , Quit If Defense Fails JERUSALEM url Dr. Fawsi El Mulka, Jordan's premier and defense minister, said Tuesday his government will resign if it can not defend the country's, borders. The premier made his statement in the light of a current probe by the United Nation Security Coun cil of charges by Jordan and the U.N. Mixed Armistice Commis sion in Palestine that Israeli forces had attacked three Jordan-held vil lages last Wednesday night and killed 66 person. Sen. McCarthy's Friend May Face Demo Grilling WASHINGTON. W Robert E. Lee, a friend of Sen. McCarthy (R-Wis) and a new Eisenhower appointee, may face sharp Demo cratic questioning when his nomi nation comes before the Senate. Sen. Monroney (D-Okla), who was chairman of a Senate subcom mittee which criticised the 1950 Maryland senatorial campaign as "despicable," mentioned Lee as being involved in the questioned handling of Republican contribu tions in that campaign. ' Monroney is a , member of the Senate Commerce Committee, which normally would act on Lee's appointment by4President Eisen hower Oct, 26 as a member of the Federal Communications Commis sion. Sen. Lyndon B. Johnson of Texas, the Democratic leader, also is a member of the committee. - Lee testified before the Senate elections subcommittee in 1951. when Monroney headed it, that he received a $5,000 check from Alvin M. Bentley, now Republican con gressman from Michigan, in a casual meeting with Bentley in McCar hy's office. Lee said the check rfas made out to the cam paign organization of John Mar shall Biitler, Republican who unseated former Sen. Millard Tyd- mgs, Maryland Democrat, in 1950 McCarthy was active in Butler's campaign. Lee said he gave the check to Butler s campaign manager who endorsed it over to Lee's wife. Lee said most of the money was used in a postcard campaign in Butler's behalf. The subcommittee said in its report that the $5,000 was not reported until after it began public hearings and was never reported to the proper Maryland authorities. Lee told a newsman Sunday he- saw nothing irregular about his acceptance of the Bentley check, and added: "I had no responsibility for reporting it.". The report was presented to a Navy Court of Inquiry, investigat ing the disaster, by Cant. Thomas A. Ahroon, commanding officer of the carrier, as he concluded his testimony. Capt. Ahroon testified the ship's records show 2,240 gallons of hy draulic fluid missing from the snip s inventory. He testified the analysis was made by a Boston Naval Shipyard laboratory from sample of sludge and burned residue, in some cases scraped from the bulkhead in the l vicinity of the fire. Cmdr. Paul E. Harlmann, exe- cutive officer of the ship, was- the ! second witness.
