June lWrtV- A U.S. Circuit Court of Appeals probably will be called upon within 48 hours to untangle a legal snarl in the affairs of Lustron Corp., big prefab house firm. This was the prediction of at taches at the U.S. district court here after these swift developments yesterday: 1. U.S. District Judge Mell G. Underwood said either the Justice department would investigate oper ations oi the S3T,500,ooo corpora tion or he would call a grand jury to do' it. 2. The Reconstruction Finance Corp., chief Lustron creditor, took possession of the huge plant after Judge Underwood approved its sale to RFC for $6,000,000. The RFC purchase was to protect its huge investment in Lustron. The firm was in default on $36.,- 500,000 in RFC loans. i. Twenty minutes after RFC took possession, U.S. District Judge Philip L. Sullivan in Chicago signed an injunction barring the RFC from taking possession of the Lus tron plant. Judge Sullivan acted at the be hest of three Lustron dealers who had filed petitions of involuntary oanicruptcy against Lustron. Just which court has jurisdiction in the situation, none could aay. It was the latter two developments InformteJ Souret $071 American Writer Dead LONDON -lPu- The death of Agnes Smedley, 56-year-old Ameri can writer on China, occurred two daya after she was operated on for stomach ulcers, an informed source says here. The cource gave out this informa tion after Rep. Hoarld H. Velde (R ill) said in Peoria, 111., that he believed Miss Smedley was liqui dated to stop her from testifying on Soviet spying before the U. S. un-American activities committee. Velde called on the British gov ernment to investigate the circum stances or miss timed ley t death last May 6. The informant here said "her death certificate was made out after a post mortem carried out by one of the outstanding patholo gists at Oxford." He said every thing was in order. The certificate said the cause of death was broncho-pneumonia, acute cardiac failure and a partial gastrectomy. Miss Smedley in February. 1949 denounced as a lie a statement in a U. Thurs,, June U, IMP The Newt-Review, Roseburg, Ore. f Budworm Kill Percentage High In Roseburg Area SALEM, June IS The spruce budworm campaign in the Rose-burg-Springfield area resulted in a kill ranging from 96.3 to St per cent, the state forestry depart ment reported Wednesday. The percentage of kill was de termined by a field survey just completed by Al Lindena and Gene Mannoch of the forestry depart ment. Approximately 28.000 acres of in fested fir timber in the Roseburg and Springfield areas were treated to a DDT apray the latter part of May in the campaign against the pest that has been destroying thou sands of acres of Oregon timber A total of 29.500 gallons of SDrav was used in treating the area. Cost Of the project was $24,213 or $8.64 an acre. This, according to. State Forester George Spaur, was the first phase of the 500,000-acre project now get ting underway in the state.
