Judge Protects Landlord
From Debt Imprisonment
PORTLAND, June 17. UP) A
federal judge yesterday refused
tp order a landlord to repay rent
overcharges because he said, it
might lead to imprisonment for
debt.
Federal Judge McColloch said
that an action brought in the
name of Tighe E. Woods, nation
al housing expediter, charged
John S. Brown, apartment house
owner, with over-collecting rents
by $282 and asked restitution.
The judge said government
counsel indicated It would en
force a restitution order by in
voking the court's contempt pow
ers. "Since I consider this to be
imprisonment for debt, which I
abhor, the order for restitution
is denied," the judge said.
