SECTION 2 Pago TWO NEWS-REVIEW. ROSEBURG, OREGON THURSDAY, OCTOBER 21, 1948 Whitewashing of Use Koch Will Be Investigated by Senate Committee By PETER EDSON NEA Washington Correspondent WASHINGTON Senate War Investigating Committee will hold nubile hearing! on the Army'a cut In sentence from life Imprison ment to lour years for Fran Use Koch, wald prison camp. "belle" of the Nazis' Buchen- Prinrinal aim of the Investi gation into the Koch case will be to find some formula to get the Armv off the hook and get Frau Koch'i sentence stepped up again. Reduction of the Koch sen fence, however, aroused a storm nf rjroteit In the United States. Frau Koch was the wife of one of the commanders 01 uucnen wald. She was accused of beat ing prisoners and of Instigating their torture. In her apartment It was said there were lamp shades made from the skin of human victims. Pragnancy Saves Hsr In all there were 31 Nazis ac cused of horrors at Buchenwald. They were tried before an eight judge military court, headed by Brig. Gen. Emll Kiel, now sta tioned at Scott Air Base, Belle ville, 111. Prosecutor at the Buchenwald trial -was Mai. William D. Pen- son of Birmingham, Ala., now an attorney for Atomic Energy Commission in Washington. De fense counsel was Mai. Carl Whitney, now stationed at the Pentagon. Washington. After sentences were handed down bv the court. Major Whit. ney went through the routine le gal move ol filing petition lor revlew and clemency. In all, 13 sentences were reduced as a re sult. Several of the death sen tences were "it to life Imprison ment. Frau Koch was given life Imprisonment instead of the death penalty because she became preg nant before her trial began and her child had not been born when she was sentenced. Record of the whole case was sent to review officer, Lt.-Col. Clio E. Straight, deputy judge ad vocate general for military gov ernment in Germany. This Is the procedure in military cases. Col onel Straight arbitrarily decided that part of the testimony against Use Koch was false or Insuffi cient evidence. He did this solely on reading the Buchenwald trial record of over 1000 pages. He did not see nor reexamine any of the witnesses. He then rec ommended that Frau Koch's sen tence be reduced from life to four years. This waa confirmed last June by Gen. Lucius D. Clay, U. S. military governor In Ger many. No announcement was made at that time. Lieutenant-Colonel Straight Is now stationed at the Penagon. He will be called as a witness before the Ferguson committee. So will William Denson, the pro secutor, and Major Whitney, the defense counsel. lvid.no. 'Hsarsay Another witness who may get chance to defend the Army's position on the Koch case is Leon B. Poullada, now In the For elgn Service Institute, Depart ment of State. Poullada was de fense counsel for the Nordhausen concentration camp war crimin als. Nordhausen was a branch of Buchenwald, but Hi staff was tried separately. Poullada has made public a long written statement on the Buchenwald and other war crimes trials. He admits that "Frau Koch was a morally de praved woman not fit for the company of decent people any where." But he claims that much of the evidence cited against her was hearsay, and that the court was swayed by prejudices. What bothers the Senate In vesligating Committee is that cutting of the Koch sentence will make the German people believe that the atrocity atorlrs were not true In the first place. White washing one of the principal Bu chenwald defendants by letting her off with a minor sentence, It Is feared, will play Into the hands of Nazis who were reluc tant to believe that anything un usual had happened In a camp where 50,000 human begins were ruthlessly exterminated, and another 20,000 starved.
