The papers filed not only alleee I that the Judge had no authority to act, but that the statute un der which the temporary injunc tion nas neen granted and the permanent injunction sought is unconstitutional. Tha defendants demurrer Is filed on the aTrounds tha "court has no juris diction over the parties or the subject matter ot tne action' that tha ' com-1 plaint doea not state sufficient facta to constitute a Cause of suit:" thst the I 'court nas no Jurisdiction of the sub ject matter or sufficient facts upon which temporary ot permanent in junction may be premised for the reason that the complaint falls to show a com oils nee with the requirement of Oregon Laws, Vol. VII, Section 102-013. to 103-929. Inclusive:" that the "com plaint alleles no allegations of the com mitment, either past or threatened, of unlawful acts of these defendants which tne court has power to enjoin. The demurrer further alleges that "on the face of the complaint and based the record on file in this case it appears that a labor dispute now ex ists and has existed between the de fendants and the plaintiffs. Involving wages, hours, working conditions and representation, and for this reason court la without jurisdiction in the above-entitled matter to issue any tem porary or permanent Injunction. "That any temporary or permanent Injunction, issued by this court or at tempted to be Issued by this court. would be void lor the reason that all of the scU whim tne said temporary injunction attempts to enjoin and all of tha acts which plaintiffs allege in their com p taint are acta which are law ful under the Constitution and laws of the state of Oregon, and tha Con stitution of the United States: that oar- ticularly said acts, as set forth In said complaint, are lawful and protected by the 'due process clause' of the Kour- teenin Amendment to tne Constitution of the United States, and Section 20. Article 1. of the constitution of the State of Oregon: that particularly the aaid temporary Injunction and any tem porary or permanent injunction which ignt be issued by this court conflicts witn the guarantees of free speech, press and assembly embodies in the a fore-mentioned constitution of the united States and tha Constitution of the Sate of Oregon." The motion to dissolve and to vacate the temporary Injunction Issued Oct. 0 and in opposition to the granting of any permanent Injunction, alleges "that the temoorsry Injunction is void and of no effect whatsoever as the same does not contain a provision that a hearing shall be held thereon within five days Irom the date of issuance thereof.
