Oregon Asks Right To Intervene In Income Tax Suit WASHINGTON, Oct. 6 (AP) As a friend of the court, the state of Oregon has asked the supreme court for authority to intervene in a case in which the supreme court has agreed to de cide whether under Oklahoma community property law a man and his wife may divide equally their total income In calculating federal Income taxes. The Internal revenue commis sioner ruled that Mr. and Mrs. C. C. Harmon of Oklahoma were not entitled to divide their total income for federal tax purposes. The tax court of the United States, however, overruled the commissioner. The Tenth federal circuit court upheld the tax court and Solicitor General Charles Fahy was granted a review of the litigation by the supreme court. Argument will be heard early In the court's present term. Attorney General Neuner of Oregon, In asking permission for Oregon to intervene, said that a like problem existed in his state because It adopted In 1943 a community property law similar to Oklahoma's. perhaps not suitable for artny use, could have been used for ci vilian automobiles.
