Ralph R Moody, sfute coordina tor, and Bruce Kpaulding. Polk county district attorney, said they would fight the application. The nigh court probably will hear the appeal about June 1. The court would have authority to free Itosser only as far us the Polk county arson charge Is con cerned. If Itosser were admitted to bail, he still would have to con tend with the Multnomah and Washington county circuit courts since he Is under indictment in those counties. Kosser tendered $65,000 in bonds In the three counties to ob tain freedom, but all these bonds were canceled after the supreme court refused to allow Itosser to appeal. Hut when the high court revers ed itself to permit Rosser's appeal, Itosser's attorneys asked Circuit Judge Walker of Polk county to admit Rosser to hail. Judge Walk er refused two weeks ago to ac cept jurisdiction; asserting it was up to the supreme court. The bond in Polk county origin ally was $100,000. but after Ros ser's conviction. Judge Walker re duced it to $25,000. Itosser, now in the Multnomah county jail, has been in jail 14 months. He was convicted of com plicity in burning the West Sa lem box factory.
