The sentence read as follows: "The squid contains a black fluid which is used for Ink " "There, you see," Knarf said tri umphantly. "Now all we have to do is to borrow some." And with 1 these words he pave a little sprinE and, strange to say. landed inside the picture. He waved to the others to follow him. which they instantly did. They found themselves at the bottom of the ocean, riht next to the squid, which was lying on a flat stone. "Good morninc," Knarf paid to the rquid, "may I borrow a liltle Ink?" Defense Case Stated This inn tier comes before the court uiion a demurrer filed by I. H. Riddle, appearing for the de fendant. W. V. Thomas, treasurer of ihe city, and as city attorney. and filing a demurrer to the amended complaint P"m Hi1 grounds that said complaint does not state facts sufficient to consti tute a cause of suit against the de fendant, Thomas, treasurer of the citv of Roseburg, and also appear ing for the city of Roseburg, and files the same demurrer to th' amended complaint. This demurrer admits the facts as alleged In the plaintiff's complaint, that Is, It ad mils i hat Ihe plaintiff whs em ploved to work by Ihe defendant citv prior to the first day of Jutu 1 upon the streets of the city In rlc'i nirii: and repairing the same, anil thai it was agreed by the cltv that he was to receive as com- pensntinn tne sum or j z;.uo per month and also that he hud not beea paid, except by the Usuance of said warrant by the recorder of the city of Roseburg on or about the first day of July. 1929, and that by order of the common coun cil of said city such warrant was i ued and delivered to the plain tiff. These facts being admitted, , the only question Is whether, as a 1 matter of Jaw, the plaintiff is en- J titled to the relief demanded Council Has Power It appears to the court, from the provisiuns of the charter of the city of Koseburg. this charter bav-j ing been adopted In 1905, that the j power to employ the plaintiff to ; perform labor which, under the ad-1 milted allegations of the complaint,1 ho bad performed, was vested in the city council. It Is alleged nd admitted that his employment was in cleaning the streets of the city of Roseburg. By subdivision 23 of the city charter of Hone burg, among other powers grunted to the city council of Keseburg, Is that ot providing for cleaning and sprink ling of the streets, and that, under this delegation of power, the city council was in the performance of its delegated duties In employing .he plaintiff. That being true, there is no question, under the pleadings In this case, but that the services were performed and that an order was made by the city council for their payment and a warrant is sued, as directed by the ordinance enacted by the city in that respect. Argument is made that the war rant is not properly a ciahn a :ainst the city because it does not appear o have been countersigned by Uie mayor of the city. It further ap pears that the mayor of the city de nies the authority of tho council io -unploy the plaintiff. I believe that each of these contentions is errone ous. In the first place, the city .barter of the city of Roseburg gives this authority to the city council, and It does not appear that it is necessary that the mayor dial! countersign the warrant for evidence of debt issued by the council. The council of the city of Roseburg on the 21st day of No vember, 1905, passed an ordinance in which, among other things. It Is provided that, "when any account shall have been allowed and or dered paid by the common council, the recorder shall draw upon the city treasurer therefor and make a record of tho same, as provided in the preceding section." This is all hat is required to be done in evi dence of the council's action. It Is contended fhat In ltdta in the e.n oral law passed authorizing tho In corporation of towns there Is a provision In that statute which provides, among other things, thai the warrant issued in evldenco of debt shall be signed by the mayor; but Dial is a provision which was passed In regard lo particular In corporated towns which were to be Incorporated under this act and. as I view it, has no application to a city charter like that of the city of Roseburg passed subsequently, giv ing to the council of the city full power to act In the matter of em ployment, similar to the instant case. Tho authority to employ is vested In the common council, and It Is admitted In thin case that the plaintiff was employed. The matter of payment is a matter which was within the power of the cily, as shown ny Ihe charter of the city. It follows, therefore, that the com mon council of the city of Rose bugr had authority to employ the plaintiff and to provide for his payment, hik! they have done so In accordance with the authority dele gated to them. Ordinance Not Necessary It is claimed also that the order or act of the council fn directing payment to the plaintiff should ave been done by an ordinance passed, but this argument Is found ed on unction 31 of tho provisions of tho charter of Roseburg, which rends as follows: "Tho power and autholty given to the council by section :t:t can only be enforced or exercised by ordinance, unless oth erwise expressly provided, and council may pass any ordinance not repungent to the laws of the Unit ed States or of this state neces sary or convenient for carrying HUl.n puwi r lir liuuim II J. ur finrt tlM'rrof.
