Hltner of Pendleton, state senator, and at one time ncllng governor, testified as a character witness for the defense today In fedoral court in the trial of John Craig, 23, Umatilla Indian, charged with possession and transportation of a gallon of wine and moonshine on the night of September 111, 19211. Rltner said he had known Craig sinco the latter was a hoy, and that he had always had a good reputation. 1 Mamie Patawa, pretty Iudlnn girl, was another witness for the defense. She nnd Lizzie Woods automobile riding with Craig and Dave Liberty the night that Craig and Liberty were arrested. Liberty pleaded guilty recently and was fined $50. Craigs defense was that Liberty bought the liquor and was tho only one in the party that drank It. . WINTER WHEAT SOWN EXCEEDS 1925 AREA (Aunclatf I'resa 1-cavil Wire,) WASHINGTON, Dec. 21. Win ter wheat was sown this fall on 41,807,000 acres which is five pur cent more than the revised esti mate of 39.399.000 acres sown in the fall of 1925, and the condition of the crop on December 1 wns 81.8 per cent of a normal, cotnpart-d wit h82.6 last year, and 84.4 the ten year average, tho Department of Agriculture announced today. Shaffer and others, a damage suit ernwine out of the Can- youville church fight, was de- nied yesterday; by Judge Hamilton. The attorneys for Mr. Dubell, who Is suing the Canyonville preacher and for- mer mayor, and member of his congregation for damages, presented their arguments for a new trial, but after listening to the reasons pres- ented the motion was over- ruled. J. Davis, -Jr., of Sutherlln, escaped Injuries when their car turned over In t'.o ditch about two miles south of Sutherlln and settled ln about four feet of water. Mr. Davis was driving and he and his wifo were soaked from the. water seeping in to the car, but otherwise wero un injured. The machine was consid erably damaged. Mrs. Davis, who Is a member of the nursing staff at Mercy hospital, was enroute to this city to resume her duties at that Institution. VETERAN DIES AT SOLDIERS HOME HOSPITAL TODAY Waller D.
