SALEM. Ore, April 8. Whether
Archie Cody, cowboy, will be saved
from death on the gallows Is now
up to Governor Pierce. Cody Is
scheduled to be hanged Friday,
April 18. 'Yesterday several rela
tives and (rlchdx of Cody, Includ
ing bis father, Burney W. Cody of
Jacksonville appeared before the
governor and presented, a petition
signed by several hundred citizens
of Jftckson county asking that the
sentence be commuted to life im
prisonment. The governor will
not announce s decision until he
has 'read ,a transcript of the testi
mony heard at the trial.
Cody was sentenced to death for
killing Siierirf Austin Goodman of
Harney cocnty. The killing, how
over, took place In Malheur county
while the sheriff was attempting to
arrest Cody for passing a bad
check. The sheriff died from a
wound In the leg and friends of
Cody contend that the wound might
)iave been Inflicted by the sheriffs
own gun. '
.Governor Pierce yesterday re
fused to disturb the sentence pass
ed on M. L. Albert of Portland,
who was convicted and sentenced
to Berve a year In the penitentiary
for receiving stolen property. He
was received at the prison last
nlzht.

ing that Jre bad mislaid his tran
scripts of testimony heard In the
trial of Tom Murray, Ellsworth
Kelley and James WJIIos, slayers
who participated In the peniten
tiary break here last August, Will
ft. King of Portland, their attorney,
asked the supreme court yesterday
for permission to substitute other
copies. This, ho said, was neces
sary so that ho can prepare briefs
In his appeal to the supreme court.
The court Is expected to grant the
request. The three prisoners are
under sentenco tq hang.
