NO PLEA BEFORE MILITARY BODY FOR MITCHELL (Continued from Pace The evidence before this court bears out there facts In their en tirety, it has been shown that at present we have only one standard plane In the service. - "Secretary Weeks and Indirectly the President were wrongly and untruthfully Informed as to tbe condition of our aviation and our national defense by the persons furnishing the data on which bis letter was based. 'This court baa refrained from ruling whether the truth In this case constitutes an - absolute de fence or not. "To proceed further with the case would serve no useful pur pose. "I have therefore directed my counsel to entirely close our part of the proceedings without argu ment ' -. ' Head Hunter Outdone.. After the defr-Tse .counsel hn.l sgrtin vrefused to make a ciorg argument, Colonel Sherman More Ir.nd, chief of the prosecution coun sel, summoned up the'evlUence. He declared that It was not necessary to prove that any breach of disci pline actually had resulted , from C lonel Mitcii-'H's conduct "All that la required is to prove the statement (Colonel Mitchell's statement attacking the war and navy departments) and the publi cation thereof," he added, "and there our responsibility rests." The truth or falsity or the Mit chell statement, he contended, did not establish a defense for the ac cused under provisions of the court martial manual. Colonel Mitchell' statement, said the prosecutor, had been Is sued at San Antonio at a time chos en "to strike the hearts and souls of the people" while they were hor rified at the Shenandoah disaster. Within 36 hours after the wreck of the dirigible he continued, -the Associated Press bad delivered the statement to more than 1200 r.evw papers throughout the countr. The prosecution counsel compar ed Colonel Mitchell' taciics to those of Flllpinio savages. "When It comes to bead bunting In the United States army." he said, "It Is time for the army lo disband."
