The opinion, written hy Justice Dean, la a revoriul o( Judge J. A. Eakln of the lower court for Clatsop county. The opinion allows a writ of mandamui commanding the coun ty court to levy a tax for 1925, and annually thereafter, of not leu than one mill nor more than 10 mllla on all taxable property In the county, Since the pro ceeding was commenced, the time for the levying of the taxes for 1923 and 11)24 has paused, there fore it is not possible to make the writ apply to these years. The law involved in the case provides that 70 per cent) of the levy shall be apportioned to the several road districts, including districts composed of incorporat ed cities and towns in such pro portion as the amount of taxable property in each district shall bear to the whole amount of taxable property In the county, and the remaining 30 per com hall be applied to roads in such locality as the county) court may direct. The county's brief alleged de fective title to the act, which con tention is not upheld by the su preme court. Getchell on the Old Oregon Trail near Hot Lake, Oregon. According to officers who Inves tigated the accident, Romig had taken a friend to Hot Lake after an evening spent In La Grande. He was returning to La Grande when he. stopped the machine. Presum ably he was putting water In the radiator when Getchell's car struck him. Coroner Ralston said an Inquest would be held late today.
