Justices Bean and Hand concur, Justice Brown concurs In the result. Justice Cosbow writes a dissenting opinion In whlrh Chief Justice Mcllrlde and Justice Burnett concur In the re sult. These differences make the decision of the court four to three. The Coshow dissent holds that the manner of making the arrest is foreign to the issue Involved In the trial, and that the only and sole Issue Is the guilt or Innocence of the defend ant. -The opinion Is believed to set a precedent In the Supremo Court relative to the search of person.
