SALEM, Oct. 13. The three
candidates for positions on the
Oregon Buprenie court bench to
be voted on ut the election No
vember 4, must have their names
on the ballot in a single group,
with no Information that they are
to be elected to fill vacancies. The
elections are to be full six year
terms. The supreme court so held
today In an opinion by Justice
Mean, in the original proceeding
in mandumus of the stute on rela
tion of C. J. Smith, plaintiff,
against Sam A. Kozer, secretary
of state, defendant.
The opinion is a victory for the
plaintiff and knocks Kozer s cer
tification of the ballott, whereby
O. I. Coshow, democratic-progressive,
and II. II. Hell, republican
appear as aspirants to fill the va
cancy caused by the resignation of
Justice Lawrence T. Harris and
sepc rate from these, Percy H.
Kellv, appears as an Independent
candidate to fill the vacancy
caused by the death of Justice
John .McCourt. Under this ar
rangement they were to be elected
to fill unexpired terms.
The opinion holds that the
manner n which Secretary Koier
arranged the names on the bal
lot Is unconstitutional.
With the three names appear
ing In a single group, and with
the voters Instructed on the bal-
I lot to vote "for two" it is gener-
ally believed that Judge O. P.
j Coshow, incumbent by appoint

vantage that he did not have with
the names arranged as certified

Also the election or Kelly was
certain as the names were arrang
ed by Kozer. since he had no op
ponent for the .McCourt vacancy,
but under the court opinion he
now has two opponents.

here as a government witness,
and had stayed at the Laidley
home for four days, "because she
thought It would be nicer than
staying at a hotel." She deiii.d
that her testimony had been in.
duelled In any way by either of
the defendants, or their at
torneys. She said she was sat
isfied with her homestead and
was now llxtng on it. The wit
ness said she did not "fully re
alize statements she had made in '
an afiidavit," to the government
authorities.
During the time Miss Anderson
was on the stand Judge Mean took
a hand In the questioning.
Mrs. Stephen A. Peck of San
lMego. Calif., was the next wit
ness. She told of being Interest
ed In an Oregon homestead and
interviewing Kill at his San lliec.j
residence on the matter. Eventu
ally the Pecks were located on a
claim on Hyde Creek. The court
also took part In the questioning
of Mrs P.-. k to bring out the full
tesiimony.
Mrs Peck testified that Kill
told her thai the fee for locating

Pass, entered a plea of guilty by
long distance telephone, and paid

ESCAPED CONVICT RETURNED

SALEM, Or., Oct. 13. Their
attempt to 'see the world' blasted
by the police officials of Doolie,
Iowa, where they were appre
hended, li. L. Sherman escaped
convict and Eldon Qulnland, 14
year old son of John Quinland,
chief engineer at the state pen
itentiary, are back In Salem to
day. They were returned from Iowa
yesterday by the father of the
boy. Bent to get them by Warden
Dalrymple: and this fliorning
Sherman related how he and the
boy evaded capture for nearly a
month, but refused to admit that
he enticed the boy Into running
away by telling him glowing stor
ies of adventure and places to be
seen, as charged by the prison
officials.
Sherman said that he met

in west Salem about 6 o'clock in
the evening of the day following
his break from the prison
srounas. From there, he said,
