II. Moore and C. V. Trudgen are equitable owners of approxi mately one-half each of the stock of Trudgen & Moore, Inc., and that a considerable portion of Moore's siock haa been pledged to Trudgen to secure an advance ment. The complaint charges that a large sum In the amount un known to Moore has been embez zled by the defendant. It is, al leged that such embezzlement consists of Trudxen pretending to pay out discounts to certain cn tnmers and converting thuu to his own use, also receiving checkf and money paid by customers to the corporation and depositing them to his own account. Complaint also charges Trud gen haspadded his expense ac count and thereby improperly paid to himself a considerable sum of money, and that he cred ited to himself an excessive sum of money in 1!C!3. It further alleges that he fails to give his entire tinre to the business of the corporation.
