INJUNCTION IS WANTED UmDaiia Broccoli Exchange r i - r.i : F Um-Qua Growers to Change Name. I The suit of the Umpqua .Broccoli Exchange against the Um-Oua Valley Broccoli Growers, Inc., came up for hearing this morning before Judge J. W. Hamilton. The Jury cases have been completed in the Circuit Court and matters of equity are now being ciiniiidered. The suit In which the ; two leading broccoli companies of the valley are involved, has caused con J sideiahle comment and attracted much g interest, and there were a large num ft Jier of growers present today to testify J on each side and to hear the case as E it was presented to the court. K The suit was brought by the Ump- qua Broccoli Exchange. Foster But V tier, tho manager, alleges that the con- cern which he represents spent a great sum of money in organizing I Riid advertising tho broccoli Industry, and that much money was expended in developing the words "Umpqua" and "Broccoli" in combination, The Umpqua Broccoli Exchange, it Is ullcgeU, was organizeu iwo years ago and is now handling Its third crop of broccoli. The Um-Qua Valloj Broccoli Growers, have been lncor- confuHlon Is caused, and It is cinimen that the defendant corporation Is anue. vara nave ueeii bcl uh mo wrong tracks, mnll has been confus ed, telegrams have been delivered to the wrong offices, and other such af fairs have occurred, It is claimed. The plaintiff asks for a permanent injunc tion preventing the defendant corpora tion from operating under tho trade name which It has assumed. In answer, R. H. C. Wood, of the I'm-Oun Vallev Broccoli Growers, al leges that he was manager of the old Vmpqua Vallev Fruit Union nnd thnt this union obtained a copyright on the trademark "l.'ni-Qua." tho word appearing within a double circle. Tho fruit union shipped broccoli under this pame for several years. It Is stated, an dconsldernble money was spent In various advertisements throughout the country. The Umpqua Villi,. v Vrnlt Union closed iid Its af fairs.' but nearly all of the stock- holders of that concern reorganized under the name of Umpqua Broccoli Growers and took over the copyright of the former organization, and t'ow claims a priority right to the use of the word "Um-tiua." n,-id alleges that because "Umpqua" and "Broccoli were used In combination by the former concern, that the new organi zation has full rights. n't... iuo.,a Involvuil l,rlnB nn mnnv 1 i..l,nl,vil noluta nf Inw and the case Is ...... -1,1. .h la l,..ln hnnl fonirht.
