Pray, Howard A. Hill, and Jesse F.
Kittson, charged with riot in connec
tion with the alleged Kidnapping and
hanging of J. K. Hale, on March 17.

Saturday evening, at 5 o'clock, after
40 minutea' deliberation.
The story of the affair for which
Norria and Coodle and a numrur of
John Doe'i were Indicted hy the tpe
clal grand Jury laat August. U as
follows: "
Johnson, the star wlinens for the
state, and Tatil York, both residents
of Jacksonville, claim they were
asked by the defendants, Norrls and
doodle, to accompany them to Arh
land. In an auto truck, for the. pur
pose df getting a piece of machinery.
The young men consented, and on
the return trip, the machinery not
being secured . wnen a snort distance
hiyond the Vothels crossing engine i
trouble developed, and a short time
later, two csrs with seven masked
men ppproached, nnd ordered Goodie
and Norrls to drive further up the
road.
Voting York was taken to one si '
and given a "lecture" and Johnson
was taken to a nearby tree, where hr
was accused of chicken stealing and
liquor violations. He denied the ac
cusations, and the rope was drawn
taut around his neck, but he wa not
lifted off the ground. Aft?r a nhort
time, Johnson was ajlowcd to go with
the query, "Nigger, can 'you run?"
The band then dispersed. Accord
ing to the reports at the time, they
all wore ma ks over tt)e face.
At the opening of ' the present
term of court. Norrls came Into court
rd chnTcd that Jrh"Son and York
had made threats against his life. In
front of the courthouse, which was
j denied. They were dlrec'ed by lb'
court to turn in their firearms which
they did.
The trial Is not expected to last
i over three or four days.

nomah county. Hanford would have
been ellgiblo for parole next month
and Payne had five months yet to

puted among his associates as not
being overly bright, he tricked a
