On Wednesday of examina tion week, Docember 14, the faculty committee sanctioned the organiza tion nf the Knppa Holla i'hl local fra ternity. Opie, Staunton, Va., broke down and wept bitterly yesterday as he de nied to the senate Investigating com mittee charges that he shot and kill ed two of his soldiers in France. Opie denied In detail the charges lodged against him by former pri vates of the A. E. F.. that he killed a runner and shot down In cold blood Wllker Woolwlne, Winchester, Va., In a shell hole. The witness, who smoked Incess antly and trembled visibly as numer ous witnesses testified against him, while others defended blm, maintain ed his composure with difficulty dur ing the first few minutes on the stand. His voice broke suddenly and he cried as he told of his decorations for distinguished service. Makes Denial. Opie said he had received the dis tinguished service cross, the croix de guerre with two palms and the French Legion of Honor. Opie faced the committee and pounded his fist on the tublo as he entered denial of the charges. 'The accusations come from di seased minds,' he declared. 'There is not an lota of truth In them." Opie admitted he fired a rifle on. October 8, 1918, to stop a retreat, but said be shot behind the men. Six former privates who served In France under Major Opie took the stand this afternoon and pronounced him innocent of charges that he shot down two American soldiers In the Argonne forest. Witness after witness branded the charges as utterly unfounded. Sev eral said they were with Opie vir tually all the time on tho days he Is alleged to have shot the men, and that such acts by him could not have been possible without their know ledge. Defends Major. Charles F. Cox, Lynchburg, Va., testified he was near Opie at all times on October 8 and 9, 1918, that he did not see Opie "fire a shot at i anything." j Howard Fifer, Staunton, Va., said i that on October 8 and 8 he saw Opie fire several shots Into the air to stop! a group of stragglers. "Opi did not aim at the soldiers," ho said, "and no one fell." I)r. Frederick Vashhrough of Gar field, N. J., gave similar testimony. Rev. John Hill, Ualtimora, former lieutenant colonel, said he investigat-l rd Oplo's conduct at tho front to see j if it warranted his being decorated ' for valor. ' "I took the enlisted men In Ople's command aside and asked them to tell me in confidence what they thought of Ople's record," Hill said. "Their reports were uniformly to Ople's credit.
