Mr. Ohmart lays: To tho editor: Recently there have appeared In the pul'llc press, articles emanating from tho pulilic health authorities attacking the proposed Anti-Compulsory Vaccination Amendment to the Stato Constitution to be voted on by tho people at the coming elec tion, November 2nd. Tho health au thorities, In these articles, attempt to misconstrue and thus to mislead the public In reference to the scope of this amendment and Its opera tion, and with this object In view, sought and obtained an opinion from a deputy city attorney, that Heems to fit in wllh tho desires of the oppon ents of tho measure. The undersigned deems It his duty at this time, inasmuch as ho prepar ed tho Initially., petition incorni, rel ating this ai diuent for the Pub lic School Protective League of Ore gon to defend this amendment against theso nujust attacks. There ctin ;o found nothing In that ameudniont that can possibly war rant tho Impression being spre:d broadcast by the health officers that It will abolish the present laws or prevent the passage of any legisla tion In tho future covering reason able quarantlno and sanitary prac tices by tho health authorities. Most kit" tllu people rightly believe in quarantine and sanitary measures. Here Is Ihe proposed Antl-Com-pulsory Vaccination Amendment, which reads as follows: "No form of vaccination or Inor- Masuuerade dance at Win- Chester Saturday night. Oct. 80. erul. Includes al kinds of medical treatment. If so, then our frlendB in the cliv hall annarently have failed to apply the elementary rules of statutory construction In making their "analysis" of thla amendment for the Health Bureau. That this amendment will abolish all the health activities of the public .minorities: that It will result in in creased epidemics and deaths, that It will Increase the population of the underworld, etc.. are highly linagin Hive assertions, for which no basis 'an be found In this amendment If the legal rules of construction are i milled It Is an elementary principle of ftaiuiory construction long estab lished utu (ecngniieil everywhere, and sunnoried by a mass of proced Bins, that "When there are general words following particular and spe cific words, the former must 06 con fined to things of the same kind This Is known as tho rule or doc trine of elusdem generis." (Suther land on Statutory Construction, Vol. ' Sec. A21. III the case of Nichols vs. state. 127 Ind. 4ifi. Ihe rule is cb-arly stated: "Tho rule is that where words of a particular description In a statute are followed by general words Hint are not so specific and limited, unless (hero lie a rliwr man- IfesljiliiHi of a contrary iiuipiwr, the general words are to be construed as applicable to persons or things or caum of like kind to those ilesig naled by tho particular words." To Illustrate. Ill a statute are the words, warehousemen, wharfingers and ol her persons. ' The words "oth er persons" tho court holds "must be understood to refer to other per sone eiusdem generis, (same general character. I" viz.. those who conduct tho business of warehousemen and wharfingers with mime other pur suit, such as shipping, grinding or manufacturing." ( lllltcher vs. Com monwealth. 1113 I'a. St. 6.161 Many Illustrations from adjucated cases could be given if space permitted. Applying this principle to our amendment, the words "or other tneillciitlon." must bo understood to refer to any medication of tho same itencriil nature or character as de- pcrlbed by the words that precede the word "inedlciitlon mat is, any nrocess of lnle tlng infectious mat ter Into the blood or body of the Individual. It Is not the purpose of this amendment to prevent anyone from voluntarily snbniltllng to vaccination or to prevent any physician from vaccinating anyone who requests It. Hut It is clearly the purpose ana substance of the amendment to pro- vent vucrlnntinn being forced iy compulsory measures upon those who do not believe 111 tho so-called cltl- cacy of vaccination and who wish anil hmild have the right to protect themselves from Its deleterious and often disastrous and fatal effects. Authentic statistics ore abundant, notwithstanding the "statistics" of the doctors to the contrary, that In- oi-ul itlim is dangerous, causes luuc.i sickness, and porno deaths, and also plants the seeds in the human sys tem of future diseases. l-'o, Mr. and Mrs. Voter, do not be deceived by the misleading prop UR iMla of the American Medical As oclatlon and Ihose w ho are interested in forcing you lo defeat this amend ment; but go to the polls anil vole in ulntlon or other medical ion, shall be lii'ide a conilillon In ibis Slate for ,h ,;,,,. , humanity and md admission to or attendance In any fr,.,.(m bv voting Ve on the public, school, college university or ,in,minont entlllM "Antt-Cninpul- otner educational lnsutuiion; or lor B)r, v.,.mitliii Amendment." tho employment of any person In any . m .,,, ,(,,, nfrinnntlvo argil capacity, or for the exerc ise of any 1 , v ,n, i.l,Ue School League. right, me periiMinancu oi any uuiy. ..,., n the pamphlet en pates 21 or the enjoyment of any privilege.' ma,.,l to all voters in the There is tint mug in tins nmenii- Ht;,(t. A large doll bride surrounded by a delicate trac ery of autumn leaves occupied the center of the table, and the guests found their places by means of s.ma'1 couplets written) on "bride anil groom" place cards. The couplets were descriptive of the guests and when read aloud caused much merri ment. Halloween favors containing a small prize and a dunce cap were given each guest. Mr. Perkins will secure na tional and state returns and will also be furnished returns from county precincts. He has secured a project ing machine and will flash returns as fast as they are received over the wires. IN THE (JOOIl OLD DAYS. Judge J. C. Fullerton in speaking of the good old campaign days of 1876. when Tllden and Hayes were presidential candidates, recalled the manner in which the national returns were received In this city. Judge Fullerton states that at that time Walt Hamilton, now mayor of Hose burg, was a telegraph operator. Wall used to "tap the wires" every morning for over a month in an at tempt to ascertain the outcome of the election, and Judge Fullerton was olio of the faithful few who gathered at the telegraph office all during that time. The real results of the election were not known for nearly two months. DKKIt HINTKIt SHOOTS MAN. MAKPHFIELD, Or.. Oct! 21.
