HORACE JONES' VICTIM OF BALLIXGKR'S SPITE Kept From Practicing in Department of Interior, He Institutes Mandamus Bait. PORTLAND, Ore., Oct. 20. Pre ferring chargeB that Richard A. Bal linger, secretary of the interior, has refused to admit him to practice In tbe department of the Interior and Its bureauB because of unfavorable testimony he gave in the Balllnger Plnchot investigation, Horace Ttllard Jones, formerly a special agent of the general land office, today tel graphed instructions to Washington, D. C, to his brother, Eugene A. Jones, to institute mandamus pro ceedings against the secretary of the Interior and tbe commissioner of the general land office compelling his ad mission. Attorney Jones has been admitted to practice not only in state courts but in tbe United States district courts and in the supreme court of tbe United States. Balllnger has been bitter toward the former special agent of the land office since the Ballinger-Pinchot bearing. Shortly after the bearing and following the "retirement" of Louis R. Glavis from service in the interior department, Mr. Jones filed his resignation. Secretary Balllnger, however, would not accept the resig nation and discharged Jones "for the good of the service." His dismissal was brought about In spite of the fact that no charges had been preferred against hira. No opportunity was given him to seek reinstatement un der the rules of tbe civil service com mission. "The truth of the statements made by Mr. Olavis and me," Bald Mr. Jones today, "has been borne out by tbe indictment in Tacoma recently of Charles F. Munday and others con nected with the Alaska' coal land frauds by the United States grand Jury., It is a peculiar fact, too, that neither Mr. Glavis nor myself were called to testify before that grand jury, although we knew tbe case from' top to bottom."
