VALE. Or., Nov. 9. After holding
out until the lnt moment under the

eaihjve tho penalty of the law. David
Wlsiirr, an old rancher of .luntiirn.
near this city, entered a pica of ttuilty
of murder In the second decree for
tho killing of bin partner. Hen Dull,
aged 20, and was sentenced by Clr
culrt Court Judg I'avU to Imprison
ment for life.
The crime was one of the most re
markable In the history of Malheur
County and was of such a character
that ft Jury would hHve had to possess
mi elastic conscience to escape from
returning ft verdict of murder In the
first degree. Nevertheless Winner,
who has resided tn this section for
many years, had an excellent record
and reputation, and none of his
neighbors supposed him capable of
crime. The tragedy followed a dispute-
between the two men. Wlsner
wishing to take from Dull some har
ness which ho was using and which
was partnership property. Dull would
not give It up, and the old man walk
ed to his home and got his shotgun.
le then npproached Dull and shot
him dead without a word of wurn-
ng.
Wlsner mado no effort to gvt away.
and when arrested was confident that
he was exempt from the vengeance of
tho law. There were and are no signs
of Insanity In the old man, and he
refused to enter any plea of menial
Irresponsibility, saying that If tho
law wanted hla life the law would
tako It, but ho did not believe until
after many conferences with his conn
sol that lie was In danger.
