This content Involved the title to a valu able claim In the Blletz district and has been pending before the depart ment for several years. The cancellation of Hoeschen's homestead entry was recommended to the Department by the register and receiver of the Portland land office, following the report of a special agent who, on Investigation, held that the entryman had not honestly com plied with the provisions of the home stead laws. The acting commissioner holds that the contestant did not sup port his charges of noii-rcsldence and non-cultivation on which he based his claim for a revocation of Boeschen's entry and orders the contest dis missed. Referring to the testimony of the entryman at the hearing of the con test before the laud office officials In Portland, the acting commissioner holds that Uoeschen settled on the land In 1901 nnd built a good house. Two years later he constructed an other house, and between the date of entry and final proof he cleared about an acre and a half of land and raised vegetables. He also set out some fruit trees. After establishing his residence, Hoeschen admitted that he way away about half the time, but never was absent from tho claim longer than six months at a time. Mu testified rurther that he was on the claim In the spring, summer and fall, but he could not remain there throughout the year for the reason thut if he did he would starve to death. During these intervals Boe schen said he worked at Toledo, Sa lem and Kugene, but declared that he had no fixed residence other than on his claim. On the question of residence. Act ing Commission Schwnrtz, In his opinion, dismissing the contest, says: "It Is true he (Boeschen) could not glvo specific dates, but owing to the lapse of time that was but nat ural. Hut he gave the approximate time ho lived on the claim and shows that his absences were caused by his necessities, and If he established resi dence, and you do not find that he did not, his subsequent ubsences may he deemed excusable. It means that the material must bo obtained by hand labor, and It requires time to cut the trees Into lengths and split tho boards that are used in the walls, roof and floor of the house. If contestee 1b tolling the truth, ho did this about a year prior to the time thnt he was entitled to submit final proof. 1 cannot construe this action otherwise than In tho en tryman's favor and against the theory of occasional visits." The dny waB fittingly observ ed by the local church. The Sunday school secretary, Frank E. Black man, reported an attendance Sunday morning of one hundred and fifty, with a special collection of $3.'i.OO for the Sunday School Board. Mrs. D. G. Palm's class of 16 girls, secured the elegnnt banner given to the class having the largest offering, which was $7.03. The Sunday school had charge of the evening service, which was a happy and highly successful one. The olllcial program wast used.
