dict $6,166.67 greater than the plain

In the case of J. C. Drynnt, repre
sentative-elect, and P. C. Whltten,
against M. C. Oriswold. The verdict
was recolved by Judge Morrow about
midnight last night after a trial last
ing three days, and now the lawyers
are wondering what the effect will be

timber lands In Lane county. This
Is all they will be able to recover,
and there appears to be some doubt
as to whether or not the verdict Is
wholly valid. Robert Treat I'latt,
who won, said ho did not know what
the effect of the unusual von lot will
be, and R. W. Montague, who, with
John M. Qearln, represented the de
fendant', wna also uncertain, but
thought the whole verdict would
fall.
The' jury apparently took a differ
ent theory of the caso of the plain
tlff. The court had pointed out this
othor' theory during the course of
the "trial, and the Jury evidently
"took a chance" In that direction.
The defense has secured 10 days In
which to move for a new trial and
also to move for setting aside the ver
dict as1 inconsistent with the findings
on special Issues.

Henry Lynch, a recent arrival from
Portland, practically closed a deal to
day for the purchase of the Roee
burg Hotel from B. R. West brook.
The change In proprietorship will go
Into effect probably tomorrow. The
corwi duration Is not elated.
Mr. Lynch will have an experi
enced hotel man here from Portland
In a short time to take the manage
ment of the buainess. In the mean
time, Mr. Wefatbrook will aid Mr.
Lynch In conducting the hostelry.
Joseph Liggett, the efficient and pop
ular clerk under Mr. West brook, will
continue permanently In the employ
of the nc-w proprietor.
Mr. Westbrook has not yet decided
whether he will remain in Roseburg,
but he may go into business some
where in California after several
weeks' well earned rest. He leaves

MARSHFIELD, Or., Oct. 20. R.
I). Hume and party and two gasoline
schooners are reported wrecked off
Gold Beach on the Curry county
coast. Whether any lives have been
lost cannot be ascertained at this
hour, all telephone communication
to the south being shut off. The lant
wire went down after a brief message
of the disaster reached here tonight.
The schooners Enterprise and Ox
trey left here for Rogue River Sun
day morning, the Enterprise being in
tow of the Oxtrey, because there
was only one captain for the two
vessels.
A heavy storm was encountered
Monday morning and the vessels
were driven ashore in the gale. The
Enterprise, valued at $10,000 la said
to be a total loss. The Oxtrey may
be saved, it is reported. It is valued
at $8,000.
Among those aboard the Oxtrey

and a travelling man in the employ
of the Fairbanks-Morse company.

Butterworth, a prominent jeweler of
St. John, was shot and lnstuntly
killed by an unknown assassin at the
entrance or his home at 9 o'clock
last night. Ills wife and children
heard him full in front of the door,
and, rushing out, found him dead.
The weapon must have been plac
el close to Hutterworth's body by
the assassin, as the report wna muffl
ed. The motive of the crime Is sur
rounded by mystery, althouKu rob
bery Is assigned by the St. John po

mond ring was missing from his fin
ger when the dead man was found.
The murderers left no clue by
which they might be traced.
