al committee, has collected a popular
subscription fund of approximately

election of presidential candidates has

fendant. Sentence wll! be pronounc
ed by Judge Hanna Monday.
An Interesting teaiure oi me

only near beer. Expert testimony of
a chemist, Karl Ingles, proved that
the near beer contained almost mm
per cent alcohol. The beer was brew
ed by the Hoseburg brewery, and as
quantities of It are being shipped
here It is likely that action will be
taken against that establishment.
Davis was defended by Aiiornej
Robert Smith, of this city. Senator
Harry Norton had charge of the pro
secution and will direct all cases on
the docket for the state. Josepn .uc
Kinney. proprietor of the Palace
hotel will be tried next. Private
Prosecutor J. O. Iiachelder of the
secret service, who prosecuted Davis
in behalf of the temperance people,
will also prosecute McKinuey, having
on several occasions, so it is alleged,
obtained liquor at the Palace. .Miles
and Carter, their partners, propriet
ors of the Layton hotel, will also be
tried.
The conviction of Davis will no
doubt result in stopping the sale or
near beer and all alcoholic "temper
ance" drinks in Josephine county, as
the analysis of the chemist, admitted
In court, proved conclusively that
such drinks contain alcohol. Judge
ilanna's Instructions to the jury,
which are precedent in this jurisdic
tion, were that any appreciable per
centage of alcohol make a drink In
toxicating, therefore It is prohibitive
under the law. Soft drink establish
ments occupying places formerly sa
loons must therefore close their
doors, as their business has consisted
mainly of selling near beer.
The trials are the result of a long
still hunt conducted by Detective
Bachelder for the temperance peo

ars, a well known resident of this
city, and at one time surveyor gen
eral of the state of Oregon, Inter
commandant of the Soldiers' Home
at HoaeburK, was severely injured
Thursday evening near the Joshua
Smith place, about two miles south
east of the city.
General Hyars and wife, in com
pany with a large number of other
members of the G. A. H. and . K
C, had been at the Smith home en
joying the hospitality of Mr. and
Mrs. Smith. Karly in the evening.
when the party broke up, General
Hyars and wife got into their rig aud
started to the city. The horse was
fractious, however, and shied at ev
erything thnt did not suit his fancy
Suddenly the beast jumped to one
side of the road and collided with a
bunch of brush. Moth Mr. and Mrs.
Hyars went over the dashboard, Mr.
Hyars landing on the ground with
great force. Mrs. Hyars fell In
cluster of small bushes and not seri
ously injured, although considerably
scratched and bruised. The racket
attracted the attention of some of
the other guests, who hurried out to
see what the trouble was. General
Hyars, ulthough painfully hurt, help
ed his wife to her feet and then went
to the house where his Injuries were
dressed by Drs. Byrd and Morse. It
was found that he had sustained an
Intra-capsular fracture at the should
er Joint, which usunlly means that
the victim Is booked for a good long
rest at home.
