PORTLAND, Or., July 17. Judge John F. Caples died at his home in this city last night of paralysis. He was "H years of age. , By the death of Judge Caples the Oregon bilr loses one of its most dis tinguished members. ' During his prime he possessed a power of jury pleading which has seldom ' been equalled. As an orator and platform speaker he uhvays enjoyed popular appreciation, and it Is said that up to a few years agu, when he with drew rrom active practice, he was known personally to more people than was any other man in Oregon. Judge Caples was born In Ashland county, Ohio, January 12, 1832. ... He early took an interest In pub lic affairs, was a delegate to the Ohio state republlcaiycoiiventlon in 1850. and attended the Chicago convention which nominated Abraham Ltneol.-. for the. presidency. He made an ac tive canvass for his election, and re marked a few days ago that the com-' ing presidential campaign would be the first in which he had not actively participated In all the intervening years. , In 1865 he brought his family to the coast via the Isthmus and Sun Francisco, to Vancouver. Wash., where he served as city attorney, re moving to Portland the next your In 1872 he was elected to the scale legislature from Multnomah county, and served as chairman of the jud1 clary committee. Judge Caples was elected dl-Urlc: attorney In 187. a responsibility which he maintained for six succes sive years, his territory comprising Multnomah, Washington, Clackamas, Columbia and Clatsop counties. He served as presidential elector lor Oregon In 1892, and was the mes senger selected to carry the state's vote to the national capital. in 1896 Judge Caples served In a similar . capacity for President u Kinley, by who he was appointed iu 1897 as the government's diplo matic representative at Valparaiso, Chile, a peculiarly delicate respnus ibillty owning the complications re sulting from the Spanish .vur. the solution of which brought iniu play the unusual diplomacy and tact which were characteristic of his en tire career. Simpson, of North Bend, are Inter ested In the company and are back ing It heavily. The objects of the company are to purchase, hold and .sell real estate, build a railroad around the shores of Coos Bay, pro mote telephone and telegraph lines and carry on other allied 'enter prises. It was brought out in the examination of Buxton that he served as a member of the Jury that convicted Charles A. Watson on a charge of perjury in the federal court In this city In August, 1908. A. G. Woodcock, of counsel for the defense, cited the federal statute of 1870, in which It was provided that a taxpayer could not he sum moned for jury service In the circuit or district court twice within a per iod of two years. In contradiction of this provision of the statute, Mr. Becker, for the government, refer red to a later statute, enacted In J87J. in which It was provided that citizens eligible to petit jury service could not be called twice within one year. After hearing argument on the question. Judge Wolverton held that the statute of 1879 in its provisions was antagonistic to the one first en noted and therefore repealed by Im plication the conflicting provisions of the statute of 1S70. The defense saved an exception of the ruling of the court. The final accent a nee of Buxton, as a juror, especially by the prosecution, was regarded .surpris ing, since It was rumored about the federal building yesterday that in the Wntpon case two vears ago. Notice of appeal to the supreme court was filed In the circuit court today by Mary E. Houck, M. C. Greg ory and Leon a Abraham from a de cision rendered by Judge Haruiltoi in favor of the City of Koseburg, on a suit brought by the other parties to enjoin the collection of an assess ment for the luylng of a sewer on th south side of the two upper block of Oak street. Plaintiffs alleged tha the assessment should have been ex tended to other parties, as well, wh were equally benefitted by the sewt: The cltv fouKht the suit on technical grounds, however, and won out. Oakland Owl. Accompanied by her son, Guy Har- dle, Mrs. John llardie. of Norman, Oklahoma, Is visiting her daugh ters, Mesdames Lynn and Earl Caton of this city. Chicago parties bid on the Oak land water bonds, but the bid was re jected by the council because tho rate of Interest was too high. Two parties are looking after the snle of the bonds and expect to sell direct to contractors for the Installation of the proposed water system. If unsuc- :essful the council will again call for bids. The probable cause for lack bids was due to a question of the legality of cities and towns having a right to amend their own charters. Tuesday the Supreme Court rendered favorable decision. - In view of this decision no further difficulty is antl- I pa ted, and it Is thought work will commence on the water Bystem with tiO days. July 10, 1908. Ho was born In Council Grove, Kansas, uly 26, 1886. His parents cumo to Wilbur, Oregon, and spent a few years and then went to Dillard, here they remained until 1900, hoy came to the city of Portland hon Mr Leonard wns about 14 yearn of age. Deceased was a nephew of Kov. F. W. Leonard, of Wilbur, and is survived by two sisters and brother. A fruit growers' association has been organized in Oakland with C B. Guinn as chairman und Phil Beck ey. as secretary. Two committees were appointed by the chairman: Phil Berkley. Lynn Caton and E. P rew as a committee to open a stock subscription book; another to frame by-laws.
