HAD MUCH LITIGATION IVni-s Which Wwo Itasis of Suit Were Shipped l-Yom Koscburn In 1017 ami the C11.se litis lleon In Court 1 Yonrs. Fruitgrowers are well pleased by the victory won by the Umpqua Val ley Fruit Union in tho Supreme Court of Washington. It marks the missing or the day when fruit was held as the plaything of the specu lator und puts it on a firm, substan tial basis as a commercial commod ity. Tbe affair started In lit 17 when, V. C. Harding, a pioneer in the fruit industry of Douglas Coun ty, shipped several carloads 01" pi'ars to C. A. Mulheouf. saled a Kent for the Northwestern Kmlt Distribu tors. These pears, it v.aa later "hewn in the court pnfemPnM, were sent from place to place by tbe agent, wlijo made little effort t dis pose of them, until they wjre finally of no commercial value and wore disposed of at a ridiculously low figure. The fruit union brought suit to collect tbe balance tWween tbe price for which the dnuiaged pears were sold and for what they would have brought had they been properly managed and a judgment for $2500 was given in tbe Circuit Court, where Attorney It. h. Kddy represented the plaintiff. The com nanv then .appealed the decision rtt tbe lower court and after a year and a half of litigation the matter was brought to a close when the Su-i nrctne Court affirmed the decision. !
